ABSTRAK Skripsi ini membahas mengenai informed consent secara lisan dalam tindakan medis. Dalam skripsi ini akan dibahas mengenai perlindungan hukum bagi pasien terhadap informed consent secara lisan, tanggung jawab bagi dokter dan rumah sakit dalam pelaksanaan informed consent secara lisan, dan analisis penerapan informed consent secara lisan dalam Putusan No. 287/Pdt.G/2011/PN.JKT.PST., No. 350/PDT/2012/PT.DKI., dan No. 215 K/PDT/2014. Tujuan penulisan skripsi ini adalah untuk memahami bagaimana informed consent secara lisan dapat diterapkan dalam suatu tindakan medis yang dilakukan oleh dokter terhadap pasien. Penelitian ini berbentuk penelitian yuridis-normatif dengan menggunakan tipe penelitian deskriptif-analitis. Hasil dari penelitian ini adalah bahwa informed consent secara lisan hanya dapat diterapkan dalam tindakan medis yang tidak berisiko tinggi dan tidak bersifat invasif. Dokter dalam melaksanakan informed consent baik secara lisan maupun tulisan harus memperhatikan serta menghargai kepentingan pasien karena informed consent merupakan salah satu hak asasi yang dimiliki oleh pasien. ABSTRACT This thesis examines the legal protection for patient towards oral informed consent, the responsibilities for the doctors and the hospitals in the implementation of oral informed consent, and the analysis the implementation of oral informed consent in Court Decisions Number 287 Pdt.G 2011 PN.JKT.PST, Number. 350 PDT 2012 PT.DKI, and Number 215 K PDT 2014. The objective of this thesis is to understand how oral informed consent can be implemented on a medical conduct that is done by doctor to patient. This research is in the form of juridical normative research with the type of descriptive analytic. The result of this research is that the oral informed consent can only be implemented on a high risk medical conduct and not invasive. To conduct the informed consent both in oral or in writing, the doctor should consider and respect the patients interest since informed consent is one of the human rsquo s right had by the patient. |
