ABSTRACT Skripsi ini membahas mengenai dasar hukum INASGOC selaku penyelenggara Asian Games 2018 yang mengasuransikan atlet Pra-Asian Games 2018. Suatu perjanjian asuransi ini harus memenuhi syarat salahsatu prinsip utama dalam hukum asuransi yakni prinsip kepentingan insurable interest. Kemudian, Penulis juga membahas mengenai sejauh mana pengaturan mengenai asuransi kesehatan atlet diatur dalam peraturan perundang-undangan tentang keolahragaan di Indonesia. Penelitian ini merupakan penelitian yuridis-normatif. Selain itu penulis menggunakan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa 1 INASGOC dalam mengasuransikan para atlet terkait, dasar hukumnya terlahir dari peraturan perundang-undangan yaitu Keputusan Presiden No. 15 Tahun 2017 tentang Panitia Nasional Penyelenggaraan ASIAN GAMES XVIII Tahun 2018 yang mana mengakibatkan timbulnya prinsip kepentingan insurable interest, 2 Peraturan perundang-undangan tentang keolahragaan belum mengatur secara khusus mengenai asuransi kesehatan bagi atlet. Dengan demikian, saran penulis dalam pembahasan ini adalah pemerintah perlu membentuk pengaturan khusus yang mengatur mengenai asuransi kesehatan atlet terlepas dari peraturan perundang-undang tentang keolahragaan. ABSTRACT This thesis discusses the legal basis of INASGOC as the organizer of the Asian Games 2018 which insures the athletes of Pre Asian Games 2018. The insurance agreement must meet the requirements one of the main insurance principles, namely principle of insurable interest. This thesis also discusses how far the regulation for athlete health insurance is regulated in Indonesian legislation, especially on sports. This is a judicial normative research. In addition to that, writer used quality analysis method. The result of the analysis shows that 1 INASGOC in insuring the athletes of Pre Asian Games 2018, the legal basis was born from the legislation which is the Presidential Decree of The Republic of Indonesia Number 15 of 2017 about National Committee of Asian Games XVIII 2018, which causes that INASGOC has a financial interest to insure the athletes, 2 Indonesia legislation on sport has not set specification about insurance health for athlete. So, the author rsquo s suggestion for this issues is the government needs to establish special regulation that regulates the athlete rsquo s health insurance regardless of the sport legislation regulation. |
