Tesis ini membahas mengenai batas waktu pertanggung jawaban Notaris terhadap akta yang dibuatnya. Hal ini perlu untuk memperoleh kepastian hukum bagi purnabakti Notaris. Pasal 1 angka 1 Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris UUJN menyatakan bahwa yang disebut sebagai Notaris adalah pejabat umum yang berwenang untuk membuat akta autentik dan kewenangan lainnya sebagaimana dimaksud dalam Undang-Undang ini. Oleh karena ini, Notaris dapat dibebani tanggung jawab atas perbuatannya sehubungan dengan pekerjaannya dalam membuat akta tersebut. Problematika yang terjadi adalah mengenai batasan tanggung jawab Notaris terhadap akta yang telah dibuatnya, perlindungan hukum terhadap purnabakti Notaris serta bagaimana kedudukan hukum pemegang protokol Notaris setelah berakhirnya jabatan Notaris. Hal ini dapat diperjelas dengan daluarsa penuntutan. Salah satu nya untuk kepastian hukum bagi Notaris yang telah menjalankan jabatannya sesuai UUJN dan Kode Etik namun kerap menjadi turut tergugat di Pengadilan. Metode penelitian ini adalah yuridis normatif dengan pendekatan kualitatif yang bersifat penelitian deskriptif analitis. Hasil yang didapat penulis adalah menentukan sampai kapan Notaris, Notaris Pengganti, Notaris Pengganti Khusus, dan Pejabat Sementara Notaris harus bertanggungjawab atas akta yang dibuatnya. Tanggung jawab Notaris adalah melekat pada dirinya hingga seumur hidup. Berakhirnya masa jabatan Notaris tidak mengakhiri tanggung jawab purnabakti Notaris atas perbuatan hukum yang dilakukan semasa jabatannya. This thesis discusses the time limit of Notary 39 s responsibility to the deed he made. It is necessary to obtain legal certainty for the retired Notary. Article 1 Sub Article 1 of Law Number 30 Year 2004 Concerning Position of Notary UUJN states that the so called Notary is a public official authorized to make authentic deed and other authority as referred to in this Law. Therefore, a Notary may be held liable for his actions in connection with his work in making the deed. The problems that occur are regarding the limitation of the responsibility of Notary to the deed which has been made, the legal protection to the retirement Notary and how the legal status of the Notary protocol holder after the termination of Notary. This can be clarified by the expiration of prosecution. One of them is for legal certainty for Notary who has carried out his her position according to UUJN and Code of Ethics but often becomes a member of the defendant in the Court. This research method is normative juridical with qualitative approach with analytic descriptive characteristic. The results obtained by the author is to determine to the extent that Notary, Notary Substitute, Notary of Special Replacement, and Official Notary Official shall be responsible for the deed he made. The responsibility of a Notary is to stick to him for life. The termination of the Notary does not terminate the responsibility of the notary public from legal acts committed during his her term of office. |
