Tesis ini membahas tentang peralihan Hak Guna Bangunan (HGB) di atas Hak Pengelolaan (HPL) sebagai obyek dari Perjanjian Kerjasama Bangun Guna Serah antara Pemerintah Kabupaten Buton dengan PT Andromeda Sakti. HGB di atas HPL memang dapat beralih dan dialihkan kepada Pihak Ketiga, namun sayangnya tidak ada aturan yang tegas apabila HGB di atas HPL tersebut adalah obyek dari suatu perjanjian pemanfaatan barang milik daerah dengan cara kerjasama BGS masih dapat dialihkan kepada pihak lain atau tidak. Jenis penelitian yang dilakukan penulis adalah penelitian yuridis normatif, yaitu penelitian yang difokuskan untuk mengkaji penerapan kaedah-kaedah atau norma-norma hukum positif, dengan tipologi penelitian yang bersifat eksplanatoris untuk menghasilkan jawaban atas rumusan permasalahan. Obyek penelitian ini akan difokuskan untuk mengkaji asas-asas hukum yang berasal dari inventarisasi hukum positif (legal positivism) dengan tujuan menganalisis mengenai pengalihan HGB di atas HPL sebagai obyek Perjanjian Kerjasama Bangun Guna Serah antara Pemerintah Kabupaten Buton dengan PT Andromeda Sakti berdasarkan peraturan perundang-undangan di Indonesia. This study regarding to the transfer of Right to Build on the land with the Right to Manage as the object of the Built Operate Transfer (BOT) Agreement between Pemerintah Kabupaten Buton with PT Andromeda Sakti. Right to Build on the land with the Right to Manage can indeed be switched and transferred to Third Party, but unfortunately there is no strict rule if Right to Build on the land with the Right to Manage as the object of an agreement of utilization of local property by way of BOT can still be transferred to other party or not. The type of research conducted by the author is normative juridical research, that is research focused on reviewing the application of rules or positive legal norms, with explanatory research typology to produce answers to the formulation of the problem. The object of this research will be focused on studying the legal principles derived from the legal positivism inventory with the aim of analyzing the transfer of Right to Build on the land with the Right to Manage as the object of the Built Operate Transfer Agreement between Pemerintah Kabupaten Buton with PT Andromeda Sakti with PT Andromeda Sakti based on legislation in Indonesia. |
