Tanggung Jawab Notaris Atas Tindakan Karyawannya Analisis Putusan Pengadilan Negeri Batam No. 926/Pid.B/2016/PN.BTM Notaris dalam menjalankan kewenangan dan kewajibannya sangat memerlukan karyawannya sebagai penunjang profesional kerjanya. Tanpa karyawan, notaris tidak dapat melaksanakan profesinya dengan cepat dan tepat waktu. Pembahasan tesis ini mengenai bentuk pertanggungjawaban notaris atas tindakan karyawannya yang melakukan penggelapan uang pembayaran pajak transaksi jual beli yang dititipkan oleh para klien notaris. Metode dalam penulisan ini bersifat yuridis normatif dengan menggunakan data sekunder. Pengolahan data dilakukan dengan metode kualitatif yaitu suatu tata cara penelitian yang menghasilkan data deskriptif analitis. Penulisan tesis ini dengan Judul Tanggung Jawab Notaris Atas Tindakan Karyawannya Analisis Putusan Pengadilan Negeri Batam Nomor 926/Pid.B/2016/PN.BTM, dan disimpulkan bahwa tanggung jawab notaris tidak terbatas hanya pada akta yang dibuat, melainkan notaris juga bertanggung jawab atas seluruh perbuatan yang dilakukan oleh karyawannya. Terkait dengan Putusan Pengadilan Negeri Batam Tanggal 19 Desember 2016 Nomor: 926/Pid.B/2016/PN.BTM, dua karyawan notaris JC yakni VLJG dan CAE dinyatakan telah melakukan penggelapan dilakukan oleh orang yang menguasai barang itu karena ada hubungan kerja dan dilakukan secara terus menerus sebagaimana tertuang pada Pasal 374 KUHP jo Pasal 55 ayat 1 ke-1 KUHP jo Pasal 64 ayat 1 , Maka berdasarkan pada ketentuan Pasal 1365 KUHPerdata dan Pasal 1367 KUHPerdata notaris JC bertanggung jawab dalam hal ini dikarenakan hubungan kerja yang terjalin diantara notaris JC dengan para karyawannya. Notaris JC mengganti seluruh kerugian uang pajak yang telah digelapkan sebagai bentuk pertanggungjawaban kepada para klien.

Without employees, a notary can not carry out his profession quickly and on time. The discussion of this thesis is about the form of responsibility of notary for the actions of employees who embezzle the payment of tax on sale and purchase transactions deposited by notary clients. The method in writing is normative juridical by using secondary data. Data processing is done by qualitative method that is a research procedure that produces analytical descriptive data. The writing of this thesis with the title of responsibility of the Notary for the Employee 39 s Action Analysis of the Decision of the Batam District Court No. 926 Pid.B 2016 PN.BTM , and concluded that the notary 39 s responsibility is not limited to only the deeds made, but the notary is also responsible for all acts committed by its employees. Related to the Decision of the Batam District Court of December 19, 2016 Number 926 Pid.B 2016 PN.BTM, two JC notary employees namely VLJG and CAE are declared to have committed embezzlement done by the person who controls the goods because there is a working relationship and done continuously as set forth in Article 374 of the Criminal Code in Article 55 paragraph 1 of the Criminal Code jo Article 64 paragraph 1 , therefore based on the provisions of Article 1365 of the Civil Code and Article 1367 Civil Code of Notary JC is responsible in this case because the working relationship is intertwined among JC notaries with employees. JC Notary substitutes all losses of tax money which has been embezzled as a form of liability to clients. |
