Notaris sebagai pengemban jabatan kepercayaan memiliki keahlian yang berkeilmuan dalam bidang kenotariatan sehingga mampu memenuhi kebutuhan masyarakat yang memerlukan pelayanan dalam bidang kenotariatan. Kasus notaris palsu yang belakangan ini marak terjadi di Indonesia tidak seharusnya terjadi dan harus segera di hentikan. Tesis ini membahas tentang peran Majelis Pengawas Notaris dalam hal adanya Notaris Palsu serta tentang upaya pencegahan baik dari segi tata cara menjadi Notaris maupun pencegahan dari sudut pandang pengguna jasa Notaris agar tidak menjadi korban serta membahas upaya hukum yang dapat dilakuan. Metode Penelitian yang di gunakan dalam tesis ini adalah Yuridis Normatif.Hasil dari penelitian ini adalah kewenangan MPN hanya meliputi, pengawasan terhadap pelaksanaan jabatan dan perilaku notaris saja, serta menunggu adanya laporan dari masyarakat atau rekan sesama notaris, namun pada praktiknya MPN juga dapat berperan aktif dan turut memeriksa ketika ada isu adanya notaris palsu di wilayahnya. Dalam hal pengawasan MPN dapat saja sewaktu-waktu menemukan adanya Notaris Palsu yaitu pada saat MPD melakukan pemeriksaan berkala ataupun pemeriksaan sewaktu-waktu dianggap perlu. Dalam hal pencegahan MPN tidak mempunyai kompetensi, kompetensi untuk mencegah adanya notaris palsu terdapat pada kepala KANWIL KEMENKUMHAM pada saat akan dilakukan pengambilan sumpah jabatan. Upaya hukum yang dapat dilakukan yaitu dengan membuat aduan kepada MPN, BPN atau penyidik Kepolisian. Notary as a trust officials has the expertise in the Public Notary field so as to meet the needs of the community who needs his services. Therefore, then a recent fake notary case often happens it should not happen. This thesis describes about the role of the Notary supervisory board relates to the existence of a fake notary and about prevention efforts both in terms of the procedures of being notary and prevention from the point of view of notary user so as not be a victim and this thesis describes about possible legal remedies. Research methods that were in use in the thesis is juridical normative.The result of research is in literature the authority of notary supervisory board only about supervision of the implementation of the title or position and behavior a notary and lurking for reports of the society or the fellow a notary, but in practice the supervisory board can also be active and also to examine when there is issue of the fake notary in the region. Before being the victim, it would be good society seeking first notified the background of a notary. The legal remedy that could be done by the people if user to become a victim of fake notary is make a report to the notary supervisory board regional, make a report to the national land agency when the notary run his position as PPAT and make report to police. |
