ABSTRAK Notaris adalah Pejabat umum yang diangkat oleh Negara untuk diberikan kewenangan membuat akta autentik. Sebagai pejabat umum Notaris tidaklah menerima gaji setiap bulan seperti yang diterima oleh pegawai negeri atau pegawai pada umumnya, melainkan pendapatan Notaris berasal dari honorarium yang diberikan oleh klien yang mempergunakan jasa dari notaris tersebut. Tesis ini membahas mengenai perlindungan hukum dan sanksi terhadap Notaris yang tidak memberikan salinan akta dalam jangka waktu relatif lama. Permasalahan yang dibahas dalam tesis ini adalah bagaimanakah bentuk perlindungan hukum bagi Notaris apabila kliennya tidak memberikan honorarium atas jasanya serta sanksi yang diterima oleh Notaris apabila tidak memberikan salinan akta dalam jangka waktu yang relatif lama. Metode penelitian yang digunakan dalam tesis ini adalah yuridis noramatif dengan tipe penelitian yang bersifat deskriptis analitis. Jenis data yang digunakan dalam penelitian ini adalah data sekunder dengan pendekatan kualitatif. Hasil Penelitian yang diperoleh dalam tesis ini adalah menahan salinan akta merupakan suatu bentuk perlindungan hukum Notaris karena tidak dibayarnya honorarium oleh kliennya atas jasanya dalam hal pembuatan akta. Meskipun merupakan bentuk perlindungan hukum bagi Notaris atas tidak dibayarnya honorariumnya akan tetapi juga merupakan suatu pelanggaran jabatan Notaris oleh karena itu Notaris yang menahan salinan akta dari kliennya dalam jangka waktu yang reatif lama dapat dijatuhi sanksi sesuai dengan ketentuan yang diatur dalam UUJN. ABSTRACT Notary is a Public Official appointed by the State who has authority to be make an authentic deed. As Public Official, Notary does not receive monthly salary like public servants or employees in general, but income Notary comes from honorarium from clients who use their services. This thesis discusses the legal protection and sanctions against the Notary who does not provided a copy of the deed in a relatively long time period. The problem discussed in this thesis is how the legal protection for the Notary if the client does not give honorarium for their services and sanctions for the Notary if they do not provide a copy of deed in a relatively long period of time. The research method used in this thesis is normative juridical with analytic descriptive type of research. The type of data used in this study is secondary data with qualitative approach. The result of the research in this thesis is holding a copy of the deed is a form of legal protection of Notary because of the unpaid honorarium by their client for their services from making the deed. Although it is a form of legal protection for a Notary for the unpaid of their honorarium but also a violation of the position of Notary therefore a Notary who holds a copy of the deed from his client in a long period of time can be sanctioned in accordance with the provisions stipulated in the UUJN. |
