Tesis ini membahas mengenai pembatalan Akta Pemberian Hak Tanggungan APHT karena dibuat tanpa persetujuan pemilik tanah. Tesis ini menganalisis dapat terbitnya APHT yang dibuat oleh PPAT tanpa persetujuan dari pemilik tanah serta menganalisis tanggungjawab PPAT terhadap APHT yang dibuatnya pada putusan Pengadilan Negeri Bekasi tanggal 18 Oktober 2016 Nomor 52/Pdt.G/2016/PN.Bks. Metode penelitian yang dipakai dalam penulisan tesis ini adalah penelitian yuridis normatif. Metode ini digunakan untuk menjawab permasalahan dalam penelitian berdasarkan asas-asas hukum, dan hukum positif yang mengatur permasalahan dalam penelitian ini, serta teori-teori pendukung lainnya.Hasil penelitian dari tesis ini adalah dapat terbitnya APHT tersebut tanpa persetujuan dari pemilik tanah yang sesungguhnya dikarenakan dalam pembuatan APHT terdapat kesalahan dalam pengecekan mengenai kebenaran identitas dari pemilik tanah yang sesungguhnya, dan tidak sesuai dengan tata cara pembuatan akta PPAT menurut peraturan. Sehingga tidak memenuhi asas-asas dari Hak Tanggungan dan juga tidak memenuhi syarat akta autentik dan mengakibatkan akta tersebut menjadi batal. PPAT MM, S.H., M.H. selaku pembuat akta turut bertanggung jawab atas APHT yang dibuatnya. Turut Tergugat I selaku PPAT dalam pembuatan APHT tersebut tidak sesuai dengan prosedur. Pada Putusan Nomor 52/Pdt.G/2016/PN.Bks, dikatakan bahwa Turut Tergugat I melakukan tindakan Perbuatan Melawan Hukum Hal ini dapat dilihat dari terpenuhinya unsur-unsur perbuatan melawan hukum tersebut secara kumulatif.
This thesis discusses the annulment of the Mortgage Deed APHT because it is made without the approval of the land owner. This thesis analyzes the APHT can be published by PPAT without the approval from the land owner and analyzes the responsibility of PPAT towards APHT which he made based to the Bekasi Court Decree Dated October 18th, 2016 No. 52 Pdt.G 2016 PN.Bks. The research method used in writing this thesis is normative juridical research. This method is used to answer problems in research based on legal principles, and positive law that regulate the problems in this study, as well as other supporting theories.The result of this thesis is the issuance of APHT without the approval of the real landowner because in the making of APHT there is a mistake in checking the correctness of the identity of the real landowner, and not in accordance with the procedure of making the PPAT deed according to the regulation. So it does not meet the principles of Mortgage Rights and also does not meet the requirements of the authentic deed and result in the deed becomes void. PPAT MM, S.H., M.H. as the author of the deed is also responsible for the APHT he made. The Respectively Defendant I as PPAT in making APHT is not in accordance with the procedure. In Bekasi Court Decree Dated October 18th, 2016 No. 52 Pdt.G 2016 PN.Bks, it is said that Participant of Respectively Defendant I performs Action Against the Law This can be seen from the fulfillment of elements of the act against the law cumulatively. |
