ABSTRAK Hukum saat ini berada pada taraf yang memprihatinkan, yaitu ketika hukum bukan saja tidak menjalankan fungsinya secara efektif, tetapi juga sering menimbulkan masalah dan memperkeruh masalah. Dilihat dari segi pembentukan hukum, Undang-Undang tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang adalah hal yang menarik untuk dikaji dari perspektif Ilmu Peraturan perundang-undangan yang memberikan tata cara formil dari proses, metode dan teknik perundang-undangan yang jauh dari ketentuan format dari undang-undang pada umumnya.Teori yang digunakan sebagai pisau analisis dalam penelitian ini menggunakan Teori Transformasi Hukum untuk mengupas harmonisasi antara Pasal 52 ayat 2 dan ayat 4 UU Nomor 12 Tahun 2011 dengan Pasal 22 ayat 2 UUD 1945 demi tercapainya tujuan Negara. Sedangkan pengkritisan mengenai konsep ideal dari Undang-Udnang tentang Penetapan Perppu menjadi Undang-Undang dikupas dengan menggunakan Teori Critical Legal Study dan Teori Hirearki Norma. Metode penelitian yang dipilih penulis berupa penelitian yuridis normatif doctrinary approach dengan pendekatan utama yaitu pendekatan statuta statute approach dan pendekatan konseptual conseptual approach . Hasil dari penelitian ini; pertama, terjadi perbedaan dalam hal dasar, tatacara dan proses pembentukan perppu, undang-undang, dan undang-undang tentang penetapan perppu menjadi undang-undang; kedua, keberadaan pasal 52 ayat 2 dan ayat 4 UU Nomor 12 Tahun 2011 bukan merupakan pengaturan lebih lanjut dari Pasal 22 ayat 2 UUD 1945; ketiga konsep ideal dapat menggunakan konsistensi nomenklatur perppu dan pengaturan atribusi kewenangan antara Presiden, DPR dan Mahkamah Konstitusi. ABSTRACT The law today is at an alarming level, when the law not only does not perform its functions effectively, but also often causes problems and complicates matters. In terms of legal formation, the Law on Stipulation of Government Regulation in Lieu of Law is interesting to be studied from the perspective of Science of Legislation which provides formal procedures of legal processes, methods and techniques that are far from the provisions of the format of the law in general. The theory used as a knife of analysis in this study uses Legal Transformation Theory to explore the harmonization between Article 52 paragraph 2 and paragraph 4 of Law Number 12 Year 2011 with Article 22 paragraph 2 of the 1945 Constitution for the achievement destination Country. While the criticism of the ideal concept of the Law on the Stipulation of the Perpu into Law is pared by using the Theory ofHierarchy Norma. The research method chosen by writer in the form of normative juridical research doctrinal approach with main approach is statute approach and conceptual approach. The results of this study firstly, there are differences in the basis, procedure and process of forming the Perpu, the law, and the law on the establishment of the legislation into law second, the existence of Article 52 paragraph 2 and paragraph 4 of Law Number 12 Year 2011 is not a further regulation of Article 22 paragraph 2 of the 1945 Constitution the three ideal concepts can use the consistency of the nomenclature of the Perpu and the arrangement of attribution of authority between the President, the Parliament and the Constitutional Court. |
