Tesis ini membahas kewenangan Pejabat Pembuat Akta Tanah (PPAT) untuk mengeluarkan pengganti Asli Akta PPAT Lembar Kedua yang hilang di Kantor Pertanahan untuk kepentingan pendaftaran tanah. Penelitian ini adalah penelitian yuridis normatif dengan deskriptif analitis. Hasil penelitian menyarankan bahwa kewenangan PPAT dalam mengeluarkan Pengganti Asli Akta PPAT Lembar Kedua berupa Fotokopi Akta PPAT Lembar Pertama tidaklah tepat, sehingga sebaiknya PPAT mengeluarkan Pengganti Akta berupa Salinan, dimana kewenangan PPAT dalam mengeluarkan Salinan dipersamakan dengan kewenangan Notaris untuk mengeluarkan Salinan Akta/Minuta jika diperlukan oleh para pihak; Adanya Laporan Kehilangan Kepolisian dan Berita Acara tentang hilangnya asli akta PPAT Lembar Kedua yang dibuat oleh Kantor Pertanahan dapat dijadikan sebagai sarana perlindungan hukum bagi Pejabat Pembuat Akta Tanah; Pihak Kantor Pertanahan bertanggung jawab atas hilangnya Asli Akta PPAT Lembar Kedua yang hilang dengan memberikan sanksi kepada Pegawai yang lalai sesuai dengan Butir 5 dan Butir 48 Lampiran Peraturan Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 16 Tahun 2013 Tentang Jenis Dan Jangka Waktu Hukuman Disiplin Bagi Pegawai Negeri Sipil Di Lingkungan Badan Pertanahan Nasional Republik Indonesia dengan hukuman paling lama 3 (tiga) bulan yang bersangkutan tidak dapat dipromosikan. Apabila melakukan pelanggaran yang sifatnya sama dijatuhi jenis hukuman lebih berat. This thesis discusses the authority of the Land Deed Official (PPAT) to issue the original replacement of the Second Sheet Act which is lost for the purpose of land registration. This research is a normative juridical research with analytical descriptive. The results suggest that the PPAT's authority in issuing the Original Substitute of the Second PPAT Deed in the form of a Photocopy of the First PPAT Deed is not appropriate, so that PPAT should issue a Substitute Deed in the form of a copy, where the PPAT authority in issuing a copy is equal to the Notary's authority to issue a Deed / Minute if necessary by the parties; The existence of the Police Loss Report and the Minutes concerning the loss of the original PPAT Second Sheet document made by the Land Office can be used as a means of legal protection for the Land Deed Making Officer; The existence of the Police Loss Report and the Minutes concerning the loss of the original PPAT Second Sheet document made by the Land Office can be used as a means of legal protection for the Land Deed Making Officer; The Land Office is responsible for the loss of the original missing PPAT Second Sheet by giving sanctions to negligent Employees in accordance with Item 5 and Item 48 of the Attachment to the Regulation of the Head of the National Land Agency of the Republic of Indonesia Number 16 of 2013 concerning the Type and Period of Disciplinary Punishment for Civil Servants Civilians in the National Land Agency of the Republic of Indonesia with a sentence of no longer than 3 (three) months, they cannot be promoted. If a violation of the same nature is given a more severe punishment. |
