Undang-Undang Pokok Agraria menganut asas yang diterapkan dalam hukum adat. Berkaitan dengan jual beli hak atas tanah, asas yang dianut adalah asas terang dan tunai yang menjadi syarat sahnya jual beli hak atas tanah. Untuk menuhi asas terang, maka jual beli harus dilaksanakan dihadapan PPAT, sedangkan untuk memenuhi asas tunai maka menjadi tanggung jawab PPAT untuk memastikan terlaksananya asas tunai sebelum terjadinya jual beli hak atas tanah. Dari hal tersebut, maka permasalahan dalam penelitian ini adalah mengenai peran dan tanggung jawaban PPAT untuk memastikan asas tunai terlaksana dalam pelaksanaan jual beli hak atas tanah khususnya dalam pembuatan Akta Jual Beli. Penulisan tesis ini menggunakan bentuk penelitian hukum yuridis normatif dengan metode kualitatif untuk menganalisis data dan tipe penelitian deskriptif analitis. Dari peraturan yang ada, diketahui bahwa peran PPAT adalah dalam memastikan dan menyesuaikan antara keterangan para pihak dengan bukti dokumen yang diperlihatkan dan/atau dilampirkan dalam minuta akta. Setelah PPAT memperoleh keyakinan berdasarkan keterangan para pihak dan menyesuaikan dengan dokumen yang ada, maka PPAT dapat mengkonstantir hal tersebut dalam akta jual beli dan kemudian akta tersebut dibacakan dan diberikan penyuluhan hukum atas pembuatan akta. Sehingga apabila terjadi sengketa di kemudain hari PPAT dapat membuktikan bahwa apa yang dinyatakan dalam akta jual beli berdasarkan keterangan para pihak dan para pihak telah memahami betul isi akta serta akibat hukum dari pembuatan akta tersebut. The Agrarian Principles Act seeks the basis applied in customary law. In relation to the sale of land rights, the basis is the light and cash principle that constitutes the legal basis of the sale of land rights. To adhere to the principle of transparency, then the sale and purchase must be executed before the PPAT, whereas to fulfill the cash basis it is the responsibility of the PPAT to ensure the execution of the cash basis before the sale of land rights. From that, the problem in this research is the role and responsibility of the PPAT to ensure that cash basis is realized in the execution of the sale of land rights especially in the making of the Sale and Purchase Deed. This thesis is using normative juridical form of research with qualitative method to analyze data and analytic descriptive research type. From the existing rules, it is known that the role of the PPAT is to ensure and adapt between the statements of the parties with the proof of the documents shown and / or attached to the minutes of the deed. Once the PPAT obtains confidence based on the parties' information and adapts to the existing documents, PPAT may then modify it in the deed of sale and then the deed is read out and given legal counseling on the deed. So in the event of a dispute in the event the PPAT day can prove that what is stated in the deed of sale and purchase by the parties' information and the parties have understood the contents of the deed and the legal consequences of making the deed. |
