Dengan berlakunya Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis Pasal 41 ayat (8) yang dimaksud dengan pengalihan hak atas suatu Merek telah selesai hal ini dimungkinkan untuk dilakukan meskipun tanda tersebut masih ada dalam tahap pendaftaran. Ini menunjukkan bahwa pengalihan dapat terjadi meskipun hak atas merek belum ada, mengingat hak atas merek baru telah muncul setelah Merek yang bersangkutan didaftarkan dan disebut sebagai merek terdaftar. Padahal, menurut Pasal 584 KUHP Hukum perdata untuk mentransfer barang, seseorang harus memilikinyakewenangan atas benda-benda tersebut terlebih dahulu, dan menurut Pasal 1320 salah satunya Keabsahan perjanjian adalah adanya "hal tertentu" atau objek yang jelas yang seharusnya tidak dipenuhi oleh merek yang masih dalam taraf Registrasi. Sekilas transfer seperti ini mirip dengan Preliminary Agreement Jual Beli atau PPJB yang dilakukan untuk jual beli rumah yang belum selesai dibangun dibangun di. Tesis ini membahas latar belakang berlakunya Pasal 41 ayat (8) Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan menganalisis bagaimana artikel ini dapat digunakan di Indonesia juga memberikan perbandingan antara pasal ini dengan PPJB yang sudah berlaku sejak lama di Indonesia. With the enactment of Law Number 20 of 2016 concerning Trademarks and Geographical Indication Article 41 paragraph (8), which means that the transfer of rights to a Mark has been completed, is possible to do this even though the sign is still in the registration stage. This indicates that the transfer can occur even though the right to a mark does not yet exist, considering that the right to a new mark has emerged after the Mark concerned has been registered and is called a registered mark. In fact, according to Article 584 of the Criminal Code Civil law to transfer goods, someone must own it authority over the said objects first, and according to Article 1320, one of the validity of the agreement is the existence of "certain things" or clear objects which should not have been fulfilled by a mark which is still in the registration stage. This thesis discusses the background to the enactment of Article 41 paragraph (8) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications and analyzes how this article can be used in Indonesia and also provides a comparison between this article and the PPJB which has been in effect for a long time in Indonesia. |
