ABSTRAK Terkait penyelenggaraan Piala Dunia FIFA 2014, ada beberapa halgugatan terkait pelanggaran hak cipta Piala Dunia FIFA 2014diposting oleh PT. ISM untuk kawasan komersial di Indonesia, khususnya ke hotel. Bahkan, beberapa hotel yang digugat tidak mengomersialkan siaran tersebut. Di sisi lain, siaran Piala Dunia FIFA 2014 dapat diakses melalui fasilitas tersebut Televisi tersedia di kamar hotel dan siaran terestrial tidak berbayar (gratis untuk air) untuk ruang lingkup tamu hotel. Nilai ganti rugi yang diminta oleh PT. ALIRAN mencapai puluhan miliar rupiah. Hal tersebut tentunya akan berdampak pada industri hotel yang merupakan bagian besar dari perekonomian Indonesia. Karena itu dalam hal tersebut terdapat indikasi adanya penyalahgunaan Hak Cipta oleh PT. ISM sebagai pemegang izin siaran Piala Dunia FIFA 2014 di Indonesia. Tesis ini membahas tentang bagaimana Pasal 82 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UUHC 2014) mengatur akibat penyalahgunaan Hak Cipta persaingan bisnis tidak sehat, bagaimana melindungi Hak Cipta dalam industri siaran televisi, dan apakah tindakan PT. ISM sedang dalam sengketa hak siar Dunia FIFA Piala 2014 yang disiarkan secara terestrial bebas mengudara untuk cakupannya tamu hotel adalah salah satu bentuk penyalahgunaan Hak Cipta. Penelitian ini adalah a penelitian yuridis-normatif dengan menggunakan data sekunder. Hasil analisis tersebut mengatakan bahwa Pasal 82 UUHC 2014 tidak mengatur secara jelas tentang penyalahgunaan hak Cipta yang mengakibatkan terjadinya persaingan usaha tidak sehat. Kemudian, terkait pengaturanPerlindungan hak cipta dalam industri penyiaran televisi juga belum diatur secara hukum lengkap. Selain itu penulis menyimpulkan bahwa tindakan PT. ISM sedang dalam sengketa hak menyiarkan Piala Dunia FIFA 2014 yang disiarkan gratis untuk lingkup tamu hotel merupakan penyalahgunaan Hak Cipta. ABSTRACT Regarding the holding of the 2014 FIFA World Cup, there are several things lawsuit related to copyright infringement of the 2014 FIFA World Cup posted by PT. ISM for commercial areas in Indonesia, especially for hotels. In fact, some of the hotels that were sued did not commercialize the broadcast. On the other hand, broadcasts of the 2014 FIFA World Cup can be accessed through these facilities. Television is available in the hotel rooms and terrestrial broadcasts are free of charge (free for water) for the scope of hotel guests. The value of compensation requested by PT. ALIRAN reaches tens of billions of rupiah. This will certainly have an impact on the hotel industry, which is a big part of the Indonesian economy. Therefore, in this case there are indications of misuse of Copyright by PT. ISM as the holder of the license to broadcast the 2014 FIFA World Cup in Indonesia. This thesis discusses how Article 82 of Law Number 28 Year 2014 concerning Copyright (UUHC 2014) regulates the consequences of copyright misuse of unfair business competition, how to protect Copyright in the television broadcast industry, and whether PT. ISM is currently in dispute over the broadcast rights of the 2014 FIFA World Cup, which is broadcast on terrestrial free to air for the coverage of hotel guests is a form of copyright abuse. This study is a juridical-normative study using secondary data. The results of the analysis state that Article 82 of the 2014 UUHC does not clearly regulate the abuse of copyright which results in unfair business competition. Then, regarding the settings Protection of copyright in the television broadcasting industry is also not fully legally regulated. In addition, the authors concluded that the actions of PT. ISM is currently in dispute over the rights to broadcast the 2014 FIFA World Cup which is broadcast free of charge to hotel guests, constituting an abuse of Copyright. |
