Asas fiktif positif merupakan asas yang menerapkan pemberian otorisasi diam-diam dalam hal otoritas gagal merespons aplikasi dalam batas waktu yang diizinkan. Kehadiran asas ini diharapkan menjadi pendobrak atas birokrasi pengambilan keputusan/tindakan oleh badan/pejabat pemerintahan yang bertele-tele. Permasalahan yang diangkat dalam tesis ini antara lain: bagaimana pengaturan asas fiktif positif di Indonesia, jenis permohonan fiktif positif apa saja yang dimintakan ke PTUN, dan bagaimana penerapan aturan tentang asas fiktif positif dalam putusan-putusan PTUN di Indonesia. Bentuk penelitian yang digunakan dalam tulisan ini adalah penelitian hukum normatif atau kepustakaan yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Dari hasil penelitian ini diketahui bahwa pengaturan mengenai asas fiktif positif di Indonesia tidak hanya terdapat dalam UU No. 30 Tahun 2014 tentang Administrasi Pemerintahan. Selain itu jenis-jenis permohonan fiktif positif yang dimintakan dalam putusan penerimaan permohonan kepada PTUN sangatlah beragam. Mengenai penerapan aturan tentang asas fiktif positif dalam putusan-putusan PTUN dapat dilihat dalam pertimbangan putusannya yang menghasilkan putusan dikabulkan, tidak diterima/NO atau ditolak. Saran dari penelitian ini antara lain adalah perlu dilakukan perubahan aturan terhadap pasal 3 UU No.5 Tahun 1986 dan penambahan aturan berupa pembatasan penerapan asas fiktif positif pada bidang-bidang tertentu, perlu dibuatnya semacam Standar Operasional Prosedur (SOP) dalam penerapan aturan mengenai asas fiktif positif, serta perlu dilakukannya upaya-upaya untuk meningkatan pemahaman masyarakat umum, para praktisi hukum serta hakim terkait penerapan aturan mengenai asas fiktif positif. The positive fictitious principle applies the granting of authorization when the authority fails to respond to the application within the permissible time limit. The presence of this principle is expected to be a battering ram on bureaucratic decision making/action by long-winded government agencies/officials. The problems raised in this thesis are: how is the regulation of positive fictitious principles in Indonesia, what kinds of positive fictitious application are requested in PTUN, and how the rule practice of positive fictional principles in PTUN decisions in Indonesia. The research form used in this paper is normative legal research or literature conducted by examining library materials or secondary data. From the research, it is known that the regulation of positive fictitious principles in Indonesia is not only contained in Law No. 30 of 2014 concerning Government Administration. In addition, the types of positive fictional applications requested in PTUN are very diverse. The practice of positive fictitious principles rules in PTUN can be seen in its consideration that result in accepted, not accepted / NO or rejected decisions. Recommendation from this research include the necessary to make changes to the rules of article 3 of Law No.5 of 1986 and to add rules limiting the application of positive fictitious principles in certain fields, the necessary to make a Standard Operating Procedure (SOP) in using positive fictitious principles, and the necessary to improve the knowledge about the rule of positive fictitious principles to the general public, legal practitioners and judges. |
