Indonesia telah mengesahkan Undang-Undang Nomor 11 Tahun 2019 tentang Sistem Nasional Ilmu Pengetahuan dan Teknologi yang di dalamnya terdapat ketentuan mengenai akses terhadap sumber daya genetik. Indonesia juga telah meratifikasi Protokol Nagoya melalui Undang-Undang Nomor 11 Tahun 2013 tentang Pengesahan Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity. Oleh karena itu, skripsi ini membahas mengenai kesesuaian antara ketentuan mengeai akses terhadap sumber dayagenetik dalam Undang-Undang 11/2019 dengan Protokol Nagoya dan Pedoman Bonn. Penelitian ini merupakan penelitian kombinasi antara penelitian deskriptif dan perskriptif dengan menggunakan pendekatan penelitian hukum normatifempiris dan menggunakan data sekunder. Permasalahan dalam penelitian ini adalah mengenai bagaimana ketentuan mengenai akses terhadap sumber daya genetik dalam Undang-Undang 11/2019, ketentuan mengenai akses terhadap sumber daya genetik dalam Protokol Nagoya dan Pedoman Bonn serta kesesuaian di antara keduanya. Dari hasil penelitian dapat disimpulkan bahwa salah satu halterkait akses sumber daya genetik yang diatur dalam Undang-Undang 11/2019 adalah mengenai prosedur mendapatkan izin penelitian namun bukan mendapatkan izin akses yang merupakan kewenangan pemerintah pusat bidang lingkungan hidup sehingga terdapat ketidaksesuaian antara Undang-Undang Sisnas Iptek dengan Protokol Nagoya dan Pedoman Bonn. Oleh karena itu dalam pengembangan RUU KKH harus dilakukan penekanan mengenai koordinasi antar wewenang dan antar lembaga dari pemerintah pusat bidang ilmu pengetahuan dan teknologi dengan pemerintah pusat bidang lingkungan hidup Indonesia has passed Law Number 11 of 2019 concerning National System of Science and Technology in which there are provisions regarding access to genetic resources. Indonesia has also ratified the Nagoya Protocol through Law Number 11 of 2013 concerning Ratification of the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity. Therefore, this research discusses the compatibility between the provisions regarding access to genetic resources in Law 11/2019 with Nagoya Protocol and Bonn Guidelines. This research is a combination of descriptive and prescriptive research using a normative-empirical legal research approach and secondary data. The core issue of this study is about how the provisions regarding access to genetic resources in Law 11/2019 with Nagoya Protocol and Bonn Guidelines are, how the provisionsregarding access to genetic resources in the Nagoya Protocol and Bonn Guidelines are and the compatibility between the two. From the result it can be concluded that one of the things related to access to genetic resources regulated in Law 11/2019 is regarding the procedure to obtain a research permit but not to obtain an access permit which is the authority of the central government in the environmental sector so that there is a discrepancy between Law 11/2019 and the Nagoya Protocol and Bonn Guidelines. Therefore, in developing the Draft of Biodiversity Conservation Act, emphasis must be placed on coordination betweenauthorities and institutions of the central government in the field of science and technology and the central government in the field of environment. |
