Seiring dengan berkembangnya zaman bertambah pula kebutuhan akan jasa Notaris. Pengguna jasa Notaris pun semakin beragam, termasuk dengan penggunaan kuasa dalam pembuatan akta. Pembuatan kuasa tidak hanya sebatas kuasa umum melainkan kuasa khusus termasuk kuasa substitusi. Notaris memiliki kewenangan untuk membuat surat kuasa substitusi, namun perlu Notaris perhatikan bahwa dibutuhkan sifat hati-hati agar tidak melakukan kesalahan yang mengakibatkan batalnya surat kuasa substitusi yang dibuatnya seperti kasus dalam putusan Nomor 199/PDT/2018/PT.MDN. Pokok masalah dalam tesis ini adalah peran Notaris dalam pembuatan surat kuasa subtitusi dan tanggung jawabnya pada putusan Nomor 199/PDT/2018/PT.MDN. Metode penelitian yang digunakan dalam penelitian ini adalah Yuridis Normatif. Tipologi penelitian ini adalah deskriptif-analitis dimana menggunakan data sekunder dengan alat pengumpulan data berupa studi literatur.Hasil dari penelitian ini, ialah Notaris memiliki kewenangan untuk membuat surat kuasa substitusi namun pembuatan surat kuasa subtitusi dalam Putusan Nomor 199/PDT/2018/PT MDN tidak dibenarkan, karena sebelum surat kuasa subtitusi dibuat terdapat surat kuasa khusus yang melarang penerima kuasa mensubtitusikan kuasanya sehingga surat kuasa subtitusi yang dibuat oleh penerima kuasa batal, selanjutnya pertanggungjawaban yang dapat dimintakan dalam Putusan Nomor 199/PDT/2018/PT MDN adalah pertanggungjawaban administrasi dan perdata. Saran dari penulis adalah Notaris harus lebih berhati-hati dan teliti sebelum membuat surat kuasa subtitusi serta sebaiknya Majelis Pengawas Daerah mengingaktkan kepada para Notaris untuk seksama dalam menjalankan jabatannya. Along the times, the need for Notary services increasing. Notary service users are also increasingly diverse, including the use of power of attorney in making the deed. The making of power is not limited to general power but special power including the power of substitution. The notary has the authority to make a substitution power of attorney, but it is necessary for the notary to note that caution is needed in order not to make a mistake which results in the cancellation of the substitution power of attorney he made as in the case in the decision of Number 199/PDT/ 2018/PT.MDN. The main problem in this thesis is the role of the Notary in making the power of attorney for substitution and its responsibility in decision Number 199/PDT/2018/ PT.MDN. The research method used in this study is Normative Juridical. The typology of this research is descriptive-analytical which uses secondary data with data collection tools in the form of literature studies.The results of this study, the Notary has the authority to make a substitution of power of attorney, but the substitution of power of attorney in Decision No.199/PDT/2018/PT MDN is not justified, because before the power of attorney was made there was a special power of attorney that prohibits the power of attorney from substituting their power of attorney so letter of substitution of attorney made by the recipient of the power of attorney is canceled, furthermore the responsibility that can be requested in Decision Number 199/PDT/2018/PT MDN is administrative and civil liability. The suggestion from the author is that the Notary must be more careful and thorough before making a substitution of attorney and the Regional Supervisory Council should notify the Notaries to be careful in carrying out their positions. |
