Tesis ini membahas tentang manfaat peran Notaris dalam mengenali Pemilik Manfaat dikaitkan dengan Pengadaan Barang/Jasa Pemerintah. Kewajiban Notaris yang muncul berdasarkan Peraturan Presiden Nomor 13 Tahun 2018 difokuskan untuk mengenali Pemilik Manfaat yang berkaitan dengan transaksi mencurigakan dan pendanaan terosime. Padalah, prinsip pemilik manfaat juga kerap digunakan oleh para pelaku usaha dalam melakukan bid rigging dalam tender Pengadaan Barang/Jasa Pemerintah. Sehingga Penulis tertarik untuk membahas bagaimana cara Notaris mengenali Pemilik Manfaat dalam Pengadaan Barang/Jasa Pemerintah, dan tanggung jawab Notaris untuk mengungkap pemilik manfaat dalam Pengadaan Barang/Jasa Pemerintah. Penelitian ini adalah penelitian Deskriptif Analitis.Hasil Penelitian ini adalah dalam mengenali pemilik manfaat, Notaris dapat menggunakan metode identifikasi, verifikasi dan pemantauan sebagaimana diatur dalam Peraturan Menteri Hukum dan Hak Asasi Manusia nomor 9 Tahun 2017, dan jika ditarik ke ranah pengadaan barang/jasa pemerintah, pengungkapan pemilik manfaat oleh Notaris sangat bermanfaat dalam membantu Panitia Tender untuk meminimalisir adanya bid rigging antara para penyedia jasa.Penulis menyarankan agar diatur mengenai identitas pemilik manfaat dalam pengadaan barang/jasa pemerintah. Sebaiknya Notaris dilibatkan sejak awal dilakukannya tender pengadaan barang/jasa pemerintah, dengan membuat regulasi sebagai dasar. Karena Notaris tidak dapat serta merta melakukan identifikasi, verifikasi dan pemantauan terhadap pemilik manfaat dalam pengadaan barang/jasa pemerintah. Regulasi yang tepat menurut penulis adalah melibatkan Notaris sebagai panitia tender. This thesis discusses the benefits of the role of the Notary in identifying the Beneficiary Owner associated with the Procurement of Government Goods / Services. The notary obligation that arises based on Presidential Regulation Number 13 Year 2018 is focused on recognizing the Beneficiary Owner relating to suspicious transactions and terorism funding. In fact, the principle of beneficial owner is also often used by business actors in conducting bid rigging in government procurement of goods / services. So the author is interested in discussing how the Notary recognizes the Beneficiary Owner in Government Goods / Services Procurement, and the Notary's responsibility to reveal the beneficial owner in Government Goods / Services Procurement. This research is a descriptive analytical study.The results of this study are in identifying the beneficial owner, the Notary can use the identification, verification and monitoring methods as regulated in Minister of Law and Human Rights Regulation number 9 of 2017, and if drawn into the realm of procurement of government goods / services, the disclosure of the beneficial owner by the Notary is very useful in helping the Tender Committee to minimize bid rigging between service providers.The author suggests that it be regulated regarding the identity of the beneficial owner in the procurement of government goods / services. Notaries should be involved since the beginning of the tender for procurement of government goods / services, by making regulations as the basis. Because the Notary cannot immediately identify, verify and monitor the beneficial owner in the procurement of government goods / services. The proper regulation according to the author is to involve a Notary Public as a tender committee. |
