ABSTRAK Tesis ini membahas mengenai pembatalan akta jual beli terhadap objek harta warisanyang belum dibagi berdasarkan studi Kasus Putusan Mahkamah Agung RepublikIndonesia Nomor 1852 K/Pdt/2018.Adapun permasalahan yang timbul mencakupmengenai pengaturan harta bersama , kewenangan subjeknya dan hak-hak pihak lainterhadap perbuatan hukum (jual beli) harta warisan sebagai harta bersama yang terikatdan analisa hukum terhadap jual beli atas harta warisan terhadap studi Kasus PutusanMahkamah Agung Republik Indonesia Nomor 1852 K/Pdt/2018 . Digunakan metodepenelitian yuridis normatif ,yakni menganalisis dasar-dasar atas pembatalan akta jualbeli atas objek harta warisan yang belum dibagi menurut Putusan Mahkamah AgungRepublik Indonesia Nomor 1852 K/Pdt/2018 sehingga dapat dilihat dari aspek yuridisatau peraturan hukum positif sekaligus menganalisa implementasi hukum tersebutdalam realitas atau kenyataan yang mengacu pada norma-norma hukum yang tertulis .Harta Bersama merupakan penyatuan harta kekayaan yang dimiliki suami istri secaraotomatis dan penyatuan harta ini sah dan tidak bisa diganggu gugat selama perkawinantidak berakhir akibat perceraian ataupun kematian. Sehubungan dengan hal tersebutapabila keduanya dipisahkan karena cerai mati , maka kewenangan subjek hartabersama jatuh kepada ahli warisnya yang merupakan harta bersama yang terikat , dalamhal ini para ahli waris mempunyai kewenangan untuk memperoleh hak nya .Dengandiperolehnya hak atas objek warisan yang belum dibagi , maka akta jual beli yangdibuat oleh Pejabat Pembuat Akta Tanah atas objek warisan yang belum dibagi bataldemi hukum dan Pejabat Pembuat Akta Tanah dapat membatalkan akta yang dibuat atasperintah pengadilan. ABSTRACT This thesis discusses the revocation of the sale and purchase deed of inheritance objectsthat have not been divided to heirs based on the Case Study of the Supreme Court of theRepublic of Indonesia Number 1852 K / Pdt / 2018. As for the problems that ariseregarding the arrangement of shared assets, the authority of the subject and the rights ofother parties to legal act (sale and purchase) of inheritance as jointly bound assets andlegal analysis of the sale and purchase of inheritance on the Case Study of the SupremeCourt of the Republic of Indonesia Number 1852 K / Pdt / 2018. Normative juridicalresearch methods are used, namely analyzing the basics of revocation the sale andpurchase deed of inheritance objects that have not been divided according to theSupreme Court Decree of the Republic of Indonesia Number 1852 K / Pdt / 2018 so thatit can be seen from the juridical aspects or positive legal regulations as well asanalyzing legal implementation mentioned in reality or reality which refers to writtenlegal norms. Joint Wealth is the integration of assets owned by husband and wifeautomatically and the integration of these assets is legal and cannot be contested as longas the marriage does not end due to divorce or death. In connection with this matter, ifthe two are separated due to divorce, the authority of the subject of joint property fallsto the heirs who are bound shared assets, in this case the heirs have the authority toobtain their rights. By obtaining the rights to inherited objects that have not been shared,then the deed of sale and purchase made by the Land Deed Makers Officer for theinherited object that has not been divided is legally canceled and the Land Deed Makersmay cancel the deed made by court order. |
