Penelitian ini membahas mengenai pungutan oleh otoritas jasa keuangan kepada notaris pengganti berdasarkan POJK nomor 67/POJK.04/2017. Dalam penelitian ini, penulis megangkat 3 (tiga) pokok permasalahan, yaitu mengenai (1) konsepsi tentang notaris pengganti pasar modal hingga terbitnya peraturan Otoritas Jasa Keuangan Nomor 67/POJK.04/2017; (2) perbandingan kedudukan notaris pengganti sebelum dan setelah adanya Peraturan Otoritas Jasa Keuangan, dan (3) tanggung jawab notaris pengganti yang telah berakhir masa jabatannya terhadap peraturan OJK selama masa keanggotaan profesi penunjang pasar modal. Untuk menjawab permasalahan hukum diatas, penulis menggunakan metode penelitian yuridis normatif. Hasil analisa adalah setelah diundangkannya Peraturan Otoritas Jasa Keuangan Nomor 67/POJK.04/2017, seharusnya dapat menguatkan kedudukan baik notaris dan notaris pengganti di pasar modal. Namun pada kenyataannya, kedudukan notaris pengganti juga tidak kuat semenjak adanya peraturan tersebut, hal ini terjadi karena setiap akta mengenai IPO (Initial Public Offering) suatu perusahaan yang dibuat oleh notaris pengganti menjadi batal demi hukum. Mengenai peraturan terkait Otoritas Jasa Keuangan yang juga tidak diatur secara jelas menyebabkan ketidak pastian terhadap kedudukan notaris pengganti, contohnya dalam hal pungutan oleh Otoritas Jasa Keuangan. Pungutan tersebut pada praktiknya tidak dikenakan untuk notaris pengganti, hal tersebut tidak sejalan dengan peraturan yang ada dimana setiap orang/badan yang melakukan kegiatan di pasar modal akan dikenakan pungutan. This study discusses levies by financial services authorities to substitute notaries based on POJK number 67 / POJK.04 / 2017. In this study, the author raised 3 (three) main issues, (1) the conception of a notary substitute for the capital market until the issuance of the Financial Services Authority Regulation Number 67 / POJK.04 / 2017; (2) to compare the position of a substitute notary public before and after the Financial Services Authority Regulation While; (3) the responsibility of a substitute notary who has ended his term of office against the FSA regulations during the membership period of the capital market supporting profession. To answer the above legal problems, the author uses the normative juridical research method. The result of the analysis is that after the enactment of the Financial Services Authority Regulation Number 67 / POJK.04 / 2017, it should be able to strengthen the position of both notary and substitute notary public in the capital market. But in reality, the position of substitute notary public is not strong since the existence of the regulation, this happens because every deed regarding Initial Public Offering (IPO) of a company made by a substitute notary is null and void. Regarding regulations related to the Financial Services Authority which are also not clearly regulated, it causes uncertainty regarding the position of a substitute notary, for example in the case of levies by the Financial Services Authority. In practice, the levies are not imposed on substitute notaries, this is not in line with the existing regulations whereby every person / body carrying out activities in the capital market will be subject to levies. |
