Tesis ini mengkaji mengenai jual beli terhadap sebidang tanah yang ternyata diketahui belakangan bahwa tanah tersebut berstatus tanah ulayat kaum yang terjadi dalam kasus Putusan Mahkamah Agung Nomor 1826 K/Pdt/2014. Mak Siri Dt Tan Aceh, Kemudian ia mensertifikatkan tanah tersebut atas nama dirinya. Setelah bersertifikat atas nama dirinya, ia menjual tanah tersebut kepada Tergugat 1 untuk kemudian Tergugat 1menjual tanah tersebut kepada Tergugat 2. Permasalahan yang terdapat dalam penelitian ini adalah tanah ulayat yang dimiliki secara kolektif seharusnya tidak dapat dijual. namun pada kasus, tanah tidak dikembalikan kepada masyarakat hukum adat selaku pemilik tanah namun tetap menjadi milik Tergugat 2. Penelitian ini bertujuan untuk mengidentifikasi hal-hal apa yang dapat menyebabkan tanah ulayat di Kota Solok dapat dialihkan serta perlindungan hukum terhadap pembeli tanah yang beritikad baik berdasarkan putusan Mahkamah Agung Nomor 1826 K/Pdt/2014. Penelitian ini menggunakan metode penelitian Yuridis Normatif dengan analisis Kualitatif dan tipe penelitian deskriptif analitis dengan menggunakan data sekunder. Hasil dari penelitian ini adalah bahwa tanah ulayat di Minangkabau tidak dapat dijualbelikan, namun dapat di jual-gadai, dengan syarat yang ditetapkan adat terpenuhi. Lebih lanjut bahwa pembeli beritikad baik, harus dilindungi undang-undang. Penggugat tidak dapat membuktikan bahwa Tergugat 2 beritikad tidak baik pada saat jual beli dilakukan, serta hakimberpendapat dalam putusan tersebut bahwa Tergugat 2 beritikad baik, sehingga kepentingannya dilindungi. Putusan Mahkamah Agung Nomor 1826 K/Pdt/2014 menolak gugatan penggugat dan menyatakan bahwa pengadilan tidak salah menerapkan aturan. This thesis studying about the sale and purchase of land which turned out to be known later that the land was the status of communal land that occurred in the case of the Verdict of the Supreme Court Number 1826 K / Pdt / 2014. Mak Siri Dt Tan Aceh, used to occupy a plot of land, which was the land of his Clan. Then he certifies the land in his name. After being certified in his name, he sold the land to Defendant 1 and then Defendant 1 sold the land to Defendant 2. The problem in this research is that collectively owned communal land should not be able to be sold. This research aims to find out what things can cause communal land in Solok City, West Sumatra to be transferred and legal protection of land buyers who have good faith both based on the Verdict of the Supreme Court Number 1826 K / Pdt / 2014. This research uses the Normative Juridical research method with qualitative analysis and analytical descriptive research type with secondary data. The results of this research are that communal land in Minangkabau cannot be transferred to anyone, communal land can be pledged to people with the agreement of all members of the clan, and the terms determined custom is fulfilled. Furthermore, the buyer in good faith must be protected by law, so in this case of the landowners represented by their mamak kepala waris must prove that Defendant 2 has the bad Faith. The Plaintiff could not prove that Defendant 2 had a badintention at the time of the sale and purchase, and the judge argued in the decision that Defendant 2 had a good intention, so that his interests were protected. Verdict of the Supreme Court Number 1826 K / Pdt / 2014 rejected the plaintiffs lawsuit and stated that the court did not mistakenly apply the rules. |
