Penelitian ini membahas mengenai pemilik objek yang tidak mengetahui, tidak pernah menghadap PPAT dan tidak pernah menandatangani akta jual beli terkait, tetapi dalam akta, pemilik objek dimaksud namanya dicatut sebagai penjual dan hak atas tanahnya dijadikan objek jual beli. Maka, ada indikasi figur palsu yang seolah-olah merupakan pihak yang berwenang guna memperlancar pembuatan akta jual beli tersebut. Adapun permasalahan yang diangkat dalam penelitian ini adalah mengenai akibat hukum terhadap akta jual beli yang cacat hukum serta tanggung jawab PPAT terhadap pembuatan akta jual beli yang cacat hukum tersebut. Pembahasan penelitian ini dilakukan melalui studi kepustakaan dan analisis Putusan Pengadilan Negeri Jakarta Timur No. 347/Pdt.G/2017/PN Jkt.Tim. Untuk menjawab permasalahan tersebut digunakan metode penelitian yuridis normatif, tipologi penelitian yang digunakan adalah penelitian deskriptif analitis dengan metode analisis data kualitatif. Hasil analisa menunjukkan bahwa akibat hukum terhadap akta yang cacat hukum karena tidak terpenuhinya syarat subjektif dan objektif perjanjian, serta syarat materiil jual beli adalah akta batal demi hukum dan tidak pernah ada. Kemudian, PPAT dapat dimintakan pertanggungjawaban secara perdata, pidana dan administrasi karena perbuatannya. Saran yang dapat diberikan adalah dalam pembuatan akta, PPAT harus lebih berhati-hati, cermat, teliti dan saksama. Selain itu, diperlukan suatu aturan yang jelas untuk menghindari penyalahgunaan identitas dan pemalsuan tanda tangan pada pembuatan akta PPAT.
This research discusses about the owner of the object who do not know, never facing the PPAT and never signed a related sale and purchase deed, but in the deed, the owner of the object is named as the seller and the rights over their land as object of sale and purchase. So, there is a fake figure who seems to be the authority to facilitate the making of the sale and purchase deed. The problems raised in this study are about the consequences of the law of the Deed of legal defects by PPAT and the responsibility of PPAT in the making of legal acts that are defective. The discussion of this research was carried out through a literature study and analysis of the Decision of the East Jakarta District Court No. 347/Pdt.G/2017/PN Jkt.Tim. To answer these problems, the method used is normative juridical research method, the research typology used is descriptive analytical research with qualitative data analysis methods. The result of the analysis is that the legal consequences of the deed are legally flawed due to the failure to fulfill the subjective and objective conditions of the agreement, as well as the material terms of the sale and purchase agreement that the deed is null and void and never existed. Then, the PPAT can be held responsible for civil, criminal and administration because of his actions. Advice that can be given is in the making of the deed, the PPAT should be more carefully and thoroughly. In addition, a clear rule is needed to avoid misuse of identity and falsification of signatures on the making of the PPAT deed. |
