Pejabat Pembuat Akta Tanah (PPAT) dalam menjalankan jabatannya harus bertanggung jawab penuh atas akta yang telah dibuat. Hal ini disebabkan karena, bila Pejabat Pembuat Akta Tanah melakukan kesalahan terhadap akta yang telah dibuat, maka sifat otentik akta tersebut akan hilang dan menjadi akta dibawah tangan. Penelitian ini memiliki pembahasan tentang tanggung jawab PPAT terhadap akta jual beli yang tidak sesuai dengan ketentuan peraturan pendaftaran tanah, dimana seharusnya dalam pembuatan akta dihadapan PPAT wajib dihadiri oleh para pihak yang memang berwenang untuk melaksanakan jual beli tersebut. Permasalahan dalam penelitian ini adalah persyaratan keabsahan Akta Jual Beli yang dibuat dihadapan PPAT dan tanggung jawab PPAT terhadap Akta Jual beli yang tidak sesuai dengan peraturan perundang – undangan yang berlaku. Penelitian ini merupakan suatu penelitian yang berbentuk yuridis normatif dan tipologi penelitian eksplanatoris. Berdasarkan hasil penelitian ini diketahui bahwa akta PPAT dapat batal demi hukum apabila dalam proses membuat aktanya tidak dilaksanakan sesuai dengan peraturan perundang – undangan yang berlaku. Selain itu atas kelalaiannya dalam membuat akta jual beli yang tidak sesuai dengan ketentuan perundang – undangan yang berlaku maka PPAT dapat bertanggung jawab dengan dikenakan sanksi berupa sanksi administratif dan sanksi perdata. Land Deed Officer in carrying out their positions must take full of responsibility for the deeds that have been made. This is because, if the Land Deed Officer makes a mistake on the deed that was made, then the authentic nature of the deed will disappear and become the hands deed under legalized. This study has a discussion about the responsibility of the Land Deed Officer to a scale purchase deed that is not fit to regulation of land registration, where the deed must be attended by the parties who are authorized to carry out the sale and purchase of the deed in the face of the Land Deed Officer. The problem in this research is the requirements for the validity of the Sale and Purchase Deed made in the face of the Land Deed Officer and the responsibility of the Land Deed Officer for the Sale and Purchase Deed that is not in accordance with the applicable laws and regulations. This research is a research in the form of normative juridical and explanatory research typology. Based on the results of this study it is known that the Land Deed Officer deed can be null and void by the law if in the process of making the deed not carried out in accordance with applicable laws and regulations. In addition to his negligence in making the sale and purchase deeds that are not in accordance with the provisions of the applicable legislation, the Land Deed Officer can be liable by being subjected to sanctions in the form of administrative sanctions and civil sanctions. |
