Dispute Settlement Understanding atau DSU merupakan suatu ketentuan yang mengatur mengenai penyelesaian sengketa antar negara-negara anggota di World Trade Organization atau WTO. Di dalamnya, DSU juga mengatur bagaimana suatu negara anggota menjalankan rekomendasi dan putusan dari Dispute Settlement Body atau DSB karena negara anggota tersebut telah melanggar perjanjian WTO. Dalam skripsi ini, penulis akan membahas secara spesifik mengenai implementasi rekomendasi dan putusan DSB dengan menggunakan kompensasi, sebagaimana kompensasi itu menurut DSU adalah tindakan penanggulangan sementara apabila negara anggota tidak mampu menjalankan rekomendasi dan putusan DSB dengan segera. Penulis mengangkat 4 sengketa, yaitu DS26, DS160, DS267, dan DS406. Dalam kasus-kasus tersebut akan ditelaah penerapan pemberian kompensasi yang dilakukan oleh para pihak terhadap ketentuan dalam DSU yang mengatur mengenai pemberian kompensasi. Hasil penelitian ini menunjukkan bahwa terjadi suatu isu hukum yang mana kompensasi yang ditetapkan oleh para pihak dalam sengketa-sengketa tersebut tidak mengikuti ketentuan DSU, seperti kompensasi yang disepakati dianggap sebagai implementasi penuh yang menyelesaikan sengketa, tidak konsistennya pemberian kompensasi dengan perjanjian WTO, dan penerapan bentuk kompensasi yang tidak diatur oleh DSU yaitu monetary compensation. Oleh karena itu, perlu dilakukan beberapa perubahan terkait ketentuan mengenai pemberian kompensasi dalam kerangka DSU untuk mengurangi timbulnya isu-isu hukum tersebut.

Dispute Settlement Understanding or DSU is a set of rules governing the settlement of disputes between Member States in the World Trade Organization or the WTO. DSU also regulates how a Member State should implement the recommendations and rulings of the Dispute Settlement Body or DSB because the Member States have violated the covered WTO agreements. In this thesis, the author will discuss the implementation of recommendations and rulings from DSB by using compensation, which according to DSU is a temporary countermeasure shall the Member State unable to implement recommendations and rulings of DSB immediately. The author raised 4 disputes, i.e. DS26, DS160, DS267, and DS406. In such cases will be examined regarding the application of compensation made by the parties in accordance with the DSU which regulates the compensation. The results showed there was a legal issue where the compensation stipulated by the parties in the disputes did not follow the provisions of the DSU, such as the agreed compensation was deemed to be a full implementation that resolves the dispute, the inconsistency of compensation with the WTO agreement, and the application of a form of compensation which is not regulated by the DSU, namely monetary compensation. Therefore, it is necessary to make some changes to the provisions regarding the compensation in the DSU framework to avoid such issues.
