Perkembangan teknologi informasi dan komunikasi sudah memasuki tahap hiperhistori dan revolusi komunikasi telah menghilangkan batasan ruang-waktu yang tetap dalam media. Perubahan ini mengubah dunia secara fundamental dan menciptakan mode masyarakat jejaring serta ekosistem digital bernama cyberspace. Keberadaan cyberspace, disertai kemampuan jejaring memproses data digital secara otonom menjadi tantangan besar bagi konsep properti intelektual. Tak hanya memperparah problem internal properti intelektual dalam mengkonstruksikan keterbatasan material pada objek imaterial, cyberspace telah menghilangkan distingsi antara proses publikasi, distribusi, dan re-distribusi, menjadi satu proses utuh yang bersifat interaktif. Artikel ini bertujuan untuk mengkritik bagaimana klaim dan paradigma yang digagas dalam teori justifikasi properti intelektual, baik secara proprietarian maupun konsekuensialis, tidak relevan dalam perkembangan teknologi informasi komunikasi. Melalui analisa konseptual, refutasi, dan elaborasi kritis, artikel ini menemukan bahwa klaim-klaim konsep properti intelektual sudah tidak relevan dalam konteks masyarakat jejaring. Kendati objek imaterial dan kreasi kultural tetap memiliki peran penting dalam sosial, namun keberadaannya dalam masyarakat jejaring lebih tepat untuk dikaji sebagai relasi dibandingkan entitas eksklusif sebagai properti.
Information and communication technology development has reached hyper history stage, and the communication revolution has surpassed the borders of fixed space-time in the media. This changes the world fundamentally and constitutes a mode of network society as well as the digital ecosystem called cyberspace. The existence of cyberspace, as well as the network’s power to process digital data autonomously, pose a great challenge to the concept of intellectual property. Not only it worsens the existing internal problem of intellectual property in its constructing material scarcity to immaterial objects, but cyberspace has also eradicated the distinction between processes of publication, distribution, and re-distribution, into one single interactive process. This article aims to criticize how intellectual property justification theory claims and paradigms, whether in proprietary view and consequentialist view, is irrelevant to the information and communication technology development. By conceptual analysis, refutation, and critical elaboration, this article exposes that intellectual property justification theory, especially as patent and copyright foundation, is incoherent within its claim in the context of the network society. In spite of the important role that immaterial object and cultural creation operate in society, its existence in the network is more suitable to be comprehended as a relation instead of the exclusive entity as a property. |
