Tesis ini adalah merupakan penelitian mengenai Sengketa tumpang tindih atas kepemilikan tanah yang dapat disebabkan oleh beberapa faktor utama, yaitu ketidakcermatan dan ketidaktelitian serta kesalahan dari pihak Kantor Pertanahan karena belum terselenggaranya tertib administrasi dalam hal prosedur pendaftaran tanah. Dari hasil penelitian ini ternyata ditemukan apabila terjadi sengketa tumpang tindih atas satu kepemilikan atas tanah, maka salah satu sertipikatnya harus dibatalkan. Yang dikaji dalam permasalahan penulisan tesis ini adalah untuk mengetahui penyebab terjadinya  sengketa tumpang tindih kepemilikan atas tanah di Palembang khususnya Desa Sukabangun, serta perlindungan secara hukum bagi pemilik sertipikat yang beritikad baik, yang dilakukan oleh pemilik tanah tersebut untuk mengajukan pendaftaran tanah pertama kali, serta upaya penyelesaian sengketa melalui proses pengadilan yang dilakukan oleh Kepala Kantor Pertanahan terhadap putusan Nomor 64/ G/2017/PTUN -PLG Jo Putusan Nomor 110 PK/TUN/2019 yang mengkibatkan dibatalkannya salah satu sertipikat oleh pengadilan

This thesis is a research on overlapping disputes over land ownership that can be caused by several main factors, namely inaccuracy and inaccuracy as well as errors on the part of the Land Office due to the absence of an orderly administration in terms of land registration procedures. From the results of this research, it is found that if there is an overlapping dispute over one land ownership, then one of the certificates must be canceled. What is studied in the problem of writing this thesis is to determine the causes of overlapping disputes over land ownership in Palembang, especially in Sukabangun Village, as well as legal protection for certificate owners who have good intentions, which is carried out by the land owner to apply for land registration for the first time, as well as dispute resolution through a court process conducted by the Head of the Land Office on the decision Number 64 / G / 2017 / PTUN-PLG Jo Decision Number 110 PK / TUN / 2019 which resulted in the cancellation of one of the certificates by the court
