Tesis ini mengenai harta bersama yang diperoleh selama perkawinan yang diperjualbelikan setelah terjadinya perceraian berdasarkan Putusan Pengadilan Negeri Pemalang Nomor 14/Pid.B/2019/PN.PML. Adapun permasalahan yang diangkat adalah akibat hukum atas jual beli harta bersama dimana salah satu pihak tidak memberikan persetujuan dan tanggung jawab yang harus dipikul oleh PPAT. Metode penelitian yang digunakan adalah yuridis normatif dengan penelusuran data sekunder dari berbagai dokumen sumber hukum primer, sekunder dan tersier. Pendekatan yang digunakan kualitatif dengan tipe penelitian deskriptif analitis. Hasil penelitian menyatakan bahwa bilamana salah satu pihak tidak mengetahui dan memberikan persetujuan atas jual beli harta bersama maka jual beli tersebut menjadi batal demi hukum karena tidak memenuhi unsur obyektif yaitu sebab yang halal. Hal tersebut dikarenakan persetujuan pasangan bersifat mutlak dalam pelaksanaan jual beli atas harta bersama. Dalam jual beli harta bersama setelah terjadinya perceraian peran penting tidak hanya berupa persetujuan dari mantan pasangan suami istri tetapi juga perlunya sikap kehati-hatian dari PPAT yakni PPAT harus hadir dan memastikan bahwa pihak yang bertandatangan adalah pihak yang berwenang. Akibat dari ketidakhati-hatian PPAT menyebabkan kerugian. Selain itu PPAT juga harus bertanggungjawab dan terancam sanksi administratif sebagaimana diatur dalam Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2018 This thesis about marital properties obtained during marriages which are traded after the divorce based on the Decision of Pemalang District Court Number 14/Pid.B/2019/PN.PML. The problem raised is the legal consequences of the sale and purchase of marital properties in which one party does not give consent and responsibility that must be borne by the Land Deed Making Officer (PPAT). The research method used is normatif juridical with secondary data retrieval from various primary, secondary and tertiary legal source document. The approach used is qualitative with descriptive analytical research type. The result of the study stated that if one of the parties does not know and give approval for the sale of marital assets the sale and purchase will be null and void by law because it does not fulfill the objective element which is halal cause. That is because the consent of the spouse is absolute in the conduct of buying and selling of joint marital properties. In the sale and purchase of marital properties after the divorce the important rule is not only in the form of approval from a former husband and wife but also the need for prudence from the PPAT that is the PPAT must be present and ensure that the signatory is an authorized party. As a result of carelessness PPAT causes losses. Because PPAT must also be responsible and threatened administrative sanction as Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 2 of 2018 |
