Tesis ini membahas kasus jual beli berantai atas objek sebidang tanah. Pada saat jual belipertama dilakukan pada tahun 1991, Notaris/PPAT tidak menuntaskan pengurusanpensertipikatannya sehingga terjadi jual beli berikut dan berikutnya lagi atas tanahtersebut sampai empat kali di tahun 2010. Hal ini berujung pada sengketa ahli waris daripembeli pertama yang mengganggu pembeli terakhir/pembeli keempat. Sengketa dimulaidi tahun 2013 di Pengadilan Negeri Kepanjen, berlanjut Kasasi dan selanjutnya PutusanMahkamah Agung No. 485/K/Pdt 2018. Permasalahan yang diangkat adalah prosesberlangsungnya jual beli oleh Notaris/PPAT dan tanggung jawab jawab Notaris/PPATterhadap objek jual beli berantai atas tanah yang di dalam sertipikat tidak tertera namapemilik tanah tersebut. Metode penelitian berbentuk yuridis normatif, dengan studidokumen melalui penelusuran literatur atas data sekunder. Adapun pendekatan analisismenggunakan pendekatan kualitatif. Hasil penelitian ini yaitu dalam penanganan suatujual beli harus dilakukan secara berhati-hati dalam memeriksa dokumen kelengkapan parapihak dan mendampingi para pihak untuk menuntaskan pengurusan pengalihan hak atastanah sampai terbitnya sertipikat. Notaris/PPAT dapat dikenakan sanksi baik berupaadministratif dan perdata. Temuan penelitian ini adalah kepastian hukum atas pemilikantanah menjadi sangat penting dan Notaris yang menerima protokol menjadi terlibat, turutterkena imbas dalam kasus ini selama lima tahun This Thesis discusses the case of a chain sale and purchase of a plot of land. The firstsale and purchase was carried out in 1991, the Notary Public/PPAT didn’t complete thearrangement of the certificate so there was a subsequent sale and purchase of the landfour times until 2010. This resulted a dispute over the heirs of the first buyer disturbedthe last buyer/fourth buyer of this land. The dispute started in 2013 at the KepanjenDistrict Court until Cassation based on the Supreme Court Decision Number 485/K/Pdt2018. The issues thas is appointed is the process of buying and selling by the NotaryPublic/PPAT and the responsibility of the Notary Public/PPAT for sale and purchasewith a chain of land whe the certificate doesn’t state the name of the land owner. Theresearch method was in the form of juridical normative, with document study throughliterature search on secondary data. The analysis approach used is qualitative approach.The result of this research is the Notary Public/PPAT in handling a sale and purchasemust be careful in examining the completeness of the parties' documents andaccompanying the parties to complete the management of the transfer of land rights untilthe issuance of the certificate. The responsibility of a Notary Public/PPAT is penalty inthe form of civil, criminal and administrative. The findings of this study are that legalcertainty of land ownership is very important and the Notary Public who received theprotocol became involved in this case for five years |
