Skripsi ini membahas mengenai perbandingan regulasi dalam tindakan pemasangan veneer estetik di Indonesia dengan Amerika Serikat. Permasalahan yang Penulis bahas dalam skripsi ini adalah mengenai perbandingan regulasi kompetensi dokter gigi serta keberlakuan hukum sertifikat pemasangan veneer estetik di Amerika Serikat dan Indonesia, dan pertanggungjawaban dokter gigi di Indonesia yang melakukan prosedur pemasangan veneer estetik dengan hanya memperoleh sertifikat kursus. Penelitian ini menggunakan metode penelitian yuridis normatif dimana Penulis meneliti regulasi serta literatur pemasangan veneer serta dengan tipe penelitian deskriptif analitis dimana penulis menyajikan analisis mengenai perbandingan regulasi terkait di Amerika Serikat dan Indonesia. Berdasarkan penelitian yang telah Penulis lakukan, Penulis berkesimpulan bahwa terdapat perbedaan kewenangan tindakan pemasangan veneer estetik dimana di Amerika Serikat telah diatur secara jelas dan rinci bahwa dokter gigi prostodonti dan dokter gigi terakreditasi oleh American Academy of Cosmetic Dentistry yang memiliki kewenangan sedangkan di Indonesia belum diatur secara jelas dan rinci. Selanjutnya di Amerika Serikat sertifikat kompetensi yang didapatkan dari pelatihan dan kursus diakui keberlakuannya sedangkan di Indonesia, meskipun banyak dokter gigi yang melakukan tindakan dokter gigi didasarkan pada sertifikat kompetensi yang di dapatkan dari kursus atau pelatihan, sertifikat tersebut belum diakui. Selanjutnya, dokter gigi umum yang tetap melakukan tindakan pemasangan veneer dapat dikenakan sanksi pelanggaran administratif dan tindakan malpraktek. Penulis menyarankan bahwa diperlukan pengaturan yang lebih rinci mengenai kompetensi dan kewenangan dokter gigi spesialis serta keberlakuan sertifikat pelatihan atau kursus di bidang kedokteran gigi dikarenakan dengan tidak diaturnya secara jelas dan rinci dapat menimbulkan kerugian bukan hanya terhadap pasien namun juga terhadap dokter gigi. This thesis discusses the comparison of regulations in the application of aesthetic veneers in Indonesia and the United States. The problems that the author discusses in this thesis are regarding the comparison of dentist’s competency regulations and the legal validity of aesthetic veneer installation certificates in the United States and Indonesia, and the responsibility of dentists in Indonesia who performs aesthetic veneer procedures by only obtaining a course certificate. This study uses a normative juridical research method where the author examines the regulations and literature of the veneer application and also use the analytical descriptive research type where the author presents an analysis of the comparison of related regulations in the United States and Indonesia. Based on the research that the author has done, the author concludes that there are differences in the authority for aesthetic veneer application actions where in the United States it has been clearly regulated that prosthodontics and dentists that are accredited by the American Academy of Cosmetic Dentistry have the authority, while in Indonesia it has not been regulated in a clear and detailed regulation. Furthermore, in the United States the competency certificate obtained from training and courses is recognized for its validity while in Indonesia, although many dentists who perform dentistry actions are based on competency certificates obtained from courses or training, the certificate has not been recognized. Furthermore, general dentists who continue to apply veneers may be subject to administrative violations and malpractice sanctions. The author suggests that a more detailed arrangement is needed regarding the competence and authority of specialist dentists as well as the validity of training certificates or courses in the field of dentistry because not being regulated clearly and in detail can cause harm not only |
