Berlakunya Undang-Undang Nomor 5 tahun 2014 tentang Aparatur Sipil Negara (UU ASN) tidak mengatur mengenai keberadaan bagi tenaga honorer sehingga kepegawaian tenaga honorer menjadi tidak jelas. Tesis ini membahas Kepegawaian Tenaga Honorer sebelum dan sesudah berlakunya Undang-Undang Nomor 5 tahun 2014 tentang Aparatur Sipil Negara, membahas Bentuk Perlindungan Hukum bagi Tenaga Honorer setelah berlakunya Undang-Undang Nomor 5 tahun 2014 tentang Aparatur Sipil Negara. Bentuk penelitian tesis ini adalah yuridis normatif, utamanya menggunakan data sekuder dengan studi dokumen melalui penelusuran dokumen. Adapun data primer yang dihasilkan dari wawancara dengan informan sebagai data pendukung, sebagai bahan mengkonfirmasi akan hasil penelitian. Analisis penelitian menggunakan pendekatan kualitatif. Hasil penelitian menunjukan sebelum adanya UU ASN, Undang-Undang Nomor 43 tahun 1999 tentang Perubahan Atas Undang-Undang Nomor 8 tahun 1974 tentang Pokok-Pokok Kepegawaian telah mengatur tentang tenaga honorer, UU tersebut memberikan celah dalam hal pengangkatan tenaga honorer, tetapi pengaturan berkenaan dengan hak dari tenaga honorer tidak ditemukan. Setelah adanya UU ASN tidak terdapat celah untuk pengangkatan tenaga honorer, karena UU ASN tidak mengatur hal-hal yang berkaitan dengan tenaga honorer. Dengan demikian perlindungan hukum bagi tenaga honorer menjadi tidak jelas, UU ASN tidak dapat menjadi pedoman bagi kepegawaian tenagahonorer. Dengan dikeluarkannya Surat iEdaran iBupati iLebak Nomor i814.1/2.227-BKPP/2018 itentang iLarangan iPengangkatan iTenaga iHonorer dan iSejenisnyabertujuan agar tidak ada lagi pengangkatan tenaga honorer di Kabupaten Lebak, danharapannya bagi tenaga honorer agar dapat segera menjadi ASN dengan mengikutiseleksi terlebih dahulu sehingga mereka bisa mendapatkan perlindungan hukum yangsetara setelah menjadi PNS atau PPPK.
The enactment of Law Number 5 of 2014 concerning State Civil Servants (ASN Law) does not regulate the existence of honorary staff so that the employment of honorary staff is unclear. This thesis discusses the Employment of Honorary Staff before and after the enactment of Law Number 5 of 2014 concerning State Civil Apparatus, discusses Forms of Legal Protection for Honorary Staff after the enactment of Law Number 5 of 2014 concerning State Civil Apparatus. The form of this thesis research is normative juridical, mainly using secondary data with document study through document search. The primary data generated from interviews with informants as supporting data, to confirm the legal materials used. This research uses a qualitative approach in analysis. The results showed that prior to the ASN Law, Law Number 43 of 1999 concerning Amendments to Law Number 8 of 1974 concerning Personnel Principles, this law provided a gap in the appointment of honorary staff, but the regulation was related to the rights of honorary staff were not found. After the existence of the ASN Law there was no gap for the appointment of honorary staff, because the ASN Law did not regulate matters related to honorary staff. Thus the legal protection for honorary staff is unclear, the ASN Law cannot serve as a guideline for honorary staffing. With the issuance of the Lebak Regent Circular Number 814.1 / 2.227-BKPP / 2018 concerning the Prohibition of Appointment of Honorary Staff and the like, the aim is that there will be no more appointment of honorary staff in Lebak Regency, and the hope is that the honorary staff can immediately become ASN by following the selection first so that they can get equal legal protection after becoming a PNS or PPPK. |
