Semenjak pandemi Covid-19 berlangsung, banyak oknum dalam sektor farmasi yang memanfaatkan keadaan untuk menjual obat Covid-19 dengan harga di atas Harga Eceran Tertinggi (HET) yang telah ditetapkan oleh Kementerian Kesehatan. Tindakan pelaku usaha ini banyak menimbulkan kerugian, khususnya terhadap konsumen, sehingga penting untuk mengetahui pengaturan perlindungan konsumen dalam undang-undang yang dapat diterapkan apabila terjadi transaksi pembelian obat Covid-19 di atas HET. Berdasarkan pengaturan tersebut, dapat diketahui pula sanksi bagi pelaku usaha yang bertanggung jawab dalam penjualan obat Covid-19 di atas HET. Penulis menggunakan metode yuridis-normatif dalam penelitian ini untuk menelaah asas-asas hukum dan sumber hukum tertulis terkait perlindungan konsumen dan penjualan obat Covid-19 dengan harga di atas HET. Hasil penelitian menunjukkan bahwa tindakan pelaku dalam hal ini telah melanggar hak asasi manusia yang diatur dalam Undang-Undang Dasar 1945 dan banyak peraturan perundang-undangan lainnya, termasuk Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Meskipun begitu, tetap dibutuhkan pengaturan yang lebih spesifik dan jelas mengenai pelanggaran terhadap HET agar perlindungan konsumen dapat lebih tegas ditegakkan dan tidak lagi menimbulkan pertanyaan atau pelanggaran lebih lanjut. Selain itu, pengawasan Pemerintah sebaiknya tidak hanya berfokus pada penjualan obat Covid-19 di pasar, melainkan juga dilakukan pengawasan sejak proses produksi, sehingga tidak ada celah bagi pelaku usaha untuk melakukan permainan harga sejak proses produksi hingga pemasaran. Since the Covid-19 pandemic took place, business actors in the pharmaceutical sector have taken advantage of this phenomenon to sell Covid-19 medicines at prices above the Maximum Retail Price (MRP) set by the Ministry of Health. The actions of these business actors cause a lot of disadvantages to the consumers, so it is important to know the regulations that can be used to protect the consumers if they encountered a Covid-19 medicines purchase transaction with prices above the MRP. Based on said regulations, penalties for the responsible business actors could also be determined. For this research, Author uses the juridical-normative method to examine legal principles and awritten legal sources related to consumer protection and the selling of Covid-19 medicines at prices above MRP. The results of this research indicate that the actions of perpetrators in this case have violated human rights regulated in the The 1945 Constitution of the Republic of Indonesia and many other laws and regulations, including Act No. 8, s. 1999 about Consumer Protection. Even so, there is still a need for more specific and clear regulations regarding violations of the MRP policy, so that the consumer protection can be enforced more firmly and no longer raise questions or further violations. In addition, the Government's supervision for this policy should not only focus on the selling of Covid-19 medicines in the market, but it also needed supervision since the production process, so there is no opportunity for business actors to manipulate the prices since the production process up to the marketing process. |
