Doktrin first sale merupakan sebuah doktrin yang memperbolehkan konsumen untuk memberikan dan menjual kembali ciptaan atau salinan ciptaan yang telah dibelinya secara sah tanpa izin dari pencipta atau pemegang hak cipta. Namun, sampai saat ini masih diperdebatkan terkait dengan penerapan doktrin first sale terhadap karya digital, salah satunya adalah terhadap e-book dikarenakan dalam mendistribusikan suatu e-book konsumen perlu untuk membuat salinan baru terlebih dahulu, dimana tindakan tersebut berada di luar ruang lingkup penerapan doktrin first sale. Selain itu, teknologi Digital Rights Management yang seringkali dipasang dalam e-book juga mencegah seseorang untuk melakukan pendistribusian e-book. Dalam menjawab permasalahan tersebut, penulis akan menggunakan pendekatan peraturan perundang-undangan dan pendekatan kasus, dimana hasil dari penelitian ini bersifat preskriptif. Kesimpulan dari penelitian ini adalah e-book yang diproteksi dengan Digital Rights Management tidaklah dijual, melainkan dilisensikan terhadap konsumen, yang dalam hal ini berbeda dengan penjualan buku cetak dan berada di luar lingkup penerapan doktrin first sale. Penelitian ini menyarankan agar pemerintah sebaiknya mengatur lebih spesifik mengenai keabsahan dari penerapan doktrin first sale dalam UU HC, khususnya terhadap karya-karya digital seperti e-book. Pengaturan ini dapat mencakup kompensasi terhadap setiap penjualan kembali yang dilakukan oleh pembeli e-book. Selain itu, aplikasi-aplikasi e-reader juga dapat menerapkan sistem yang memperbolehkan seseorang untuk memberikan suatu e-book tanpa harus menggandakannya terlebih dahulu. The first sale doctrine allows consumers to sell or otherwise dispose the works or particular copies of the works that they have legally purchased, without the authority of the copyright owner. However, there has been a wide and varied debate regarding its application towards digital works, such as e-books where the buyer has to make a new copy for the new owner, in which it is considered to be outside the scope of the first sale doctrine. Moreover, the Digital Rights Management technology that is often implemented in e-books will prevent someone from distributing the e-books that they have bought. The author will use the statutory approach and the case approach to answer those issues, where the result of this study will be prescriptive. This study found that unlike its printed counterpart, e-books that are protected by Digital Rights Management are licensed, not sold, meaning that the first-sale doctrine cannot serve as a legal milestone towards the distribution of e-books. The study suggests that the amendment of Indonesian Copyright Act should include provisions regarding the first sale doctrine, especially towards digital works like e-books. These new provisions can include compensation and royalties every time a buyer resell an e-book that they have previously purchased. Furthermore, e-reader apps should implement a system that allows the consumers to lend or give an e-book without having to make a new copy beforehand. |
