Akta Hibah yang dibuat tanpa sepengetahuan pemilik atas tanah yang sah merupakan perbuatan melawan hukum.Pejabat Pembuat Akta Tanah (PPAT) maupun Pejabat Pembuat Akta Tanah Sementara (PPATS) yang membuat suatu akta seperti akta hibah tanpa memperhatikan kedudukan penghadap yang berhak melakukan perbuatan hukum dalam akta, dianggap sebagai perbuatan melawan hukum dan berkaitan dengan akta tersebut menjadi batal demi hukum karena melanggar syarat materiil hibah dalam akta tersebut. Penelitian ini mengangkat permasalahan tentang tanggung jawab pejabat pembuat akta tanah sementara terhadap akta hibah yang dibuat tanpa persetujuan pemilik atas tanah yang sah berdasarkan putusan Mahkamah Agung Nomor 95/K/Pdt/2021 dan keabsahan akta hibah yang dibuat oleh Pejabat Pembuat Akta Tanah Sementara tersebut. Untuk menjawab permasalahan tersebut, penelitian ini menggunakan pendekatan yuridis normatif. Keterbaruan dalam penelitian ini yaitu pada kasus yang diangkat mengenai pembuatan jenis aktanya, yaitu akta hibah oleh Pejabat Pembuat Akta Tanah Sementara tersebut tanpa sepengetahuan pemilik atas tanah yang sah, berbeda dengan beberapa tesis yang lain di mana kasus-kasunya membahas jenis akta jual beli. Hasil dari penelitian ini adalah akta yang dibuat oleh Pejabat Pembuat Akta Tanah Sementara tersebut batal demi hukum, dan Pejabat Pembuat Akta Tanah Sementara tersebut dapat dikenakan pertanggungjawaban administrasi dan pidana sebagai jalan terakhir (ultimum remedium) The Deed of Grant made without the knowledge of the owner of the legal land is against the law. Land Deed Making Officials (PPAT) and Temporary Land Deed Making Officials (PPATS) who make a deed such as a grant deed without regard to the position of the appearers who are entitled to take legal actions in the deed , is considered an unlawful act and related to the deed becomes null and void because it violates the material terms of the grant in the deed. This study raises the issue of the responsibility of the temporary land deed official for the grant deed made without the consent of the owner of the legal land based on the Supreme Court's decision No. 95/K/Pdt/2021 and the validity of the grant deed made by the Temporary Land Deed Official. To answer these problems, this research uses a normative juridical approach. The novelty in this research is the case raised regarding the making of the type of deed, namely the deed of grant by the Temporary Land Deed Official without the knowledge of the owner of the legal land, in contrast to several other theses where the cases discuss the type of deed of sale and purchase. The result of this research is that the deed made by the Temporary Land Deed Official is null and void, and the Temporary Land Deed Official can be subject to administrative and criminal liability as a last resort (ultimum remedium). |
