Peraturan perundang-undangan yang mengatur tentang barang sitaan negara terdiri dari Undang Undang No.8 Tahun 1981 , Permenkumham R.I. Nomor 16 Tahun 2014, Kepmen. Kehakiman RI Nomor : M.04.PR.07.03Tahun 1985, Keputusan Dirjen. Pemasyarakatan Kemenkumham RI Nomor PAS-140.PK.02.01 Tahun 2015 , Peraturan Bersama Kepala Kepolisian Negara RI, Jaksa Agung RI, Komisi Pemberantasan Korupsi RI, Menteri Hukum dan HAM RI, Mahkamah Agung RI dan Menteri Keuangan RI. No: 2 Tahun 2011; No: KEP/259/A/JA/12/2011; , namun dari peraturan tersebut diatas belum ada yang mengatur mengenai barang sitaan negara yang tidak bergerak dan memiliki nilai tinggi tanah dan bangunan khususnya pengamanan aset sedangkan di lembaga kejaksaan sudah ada tentang pengamanan aset berupa tanah dan bangunan dalam PERJA Tentang Pedoman Pemulihan Aset . Hal ini menimbulkan permasalahan , yaitu : Bagaimana aturan pengelolaan Barang Rampasan Negara tidak bergerak yang dikelola Rupbasan , Bagaimana Pelaksanaan pengelolaan Barang Rampasan Negara tidak bergerak selama ini di dalam Rupbasan . Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif, dengan menggunakan data primer dan data sekunder. Hasil penelitian ini menyimpulkan bahwa belum ada aturan mengenai barang sitaan negara berupa tanah dan bangunan. Saran permasalahan ini adalah perlunya aturan dirjen pas mengenai pengelolaan benda tidak bergerak yang ada dalam rupbasan terkait pengamanan aset tanah dan bangunan , memperhatikan anggaran perawatan benda sitaan negara khusunya berupa tanah dan bangunan.

This raises problems, namely: What are the rules for managing immovable State confiscated goods managed by the Rupbasan, how is the implementation of the management of immovable State confiscated goods in the Rupbasan. The method used in this study is a normative juridical method, using primary data and secondary data. The results of this study conclude that there are no regulations regarding state confiscated goods in the form of land and buildings. Suggestions for this problem are the need for regulations from the Director General of Past regarding the management of immovable objects in the General Meeting of Shareholders related to securing land and building assets, paying attention to the maintenance budget for state confiscated objects, especially in the form of land and buildings. |
