Skripsi ini membahas tentang penerapan restorative justice dalam penyelesaian kasus pencemaran nama baik pada Subdit IV Tipid Siber Polda Metro Jaya. Skripsi ini menggunakan pendekatan kualitatif dengan studi kasus pencemaran nama baik yang terjadi di Twitter X. Peneliti melakukan observasi dan wawancara kepada empat informan penelitian. Dengan mengaitkannya dengan konsep-konsep dalam restorative justice, peneliti menemukan faktor yang mempengaruhi penerapan restorative justice. Selain itu, peneliti juga menganalisis elemen yang terdapat dalam penerapan restorative justice, peranan kepolisian, dan keberhasilan restorative justice. Hasil penelitian membuktikan, bahwa ada faktor internal, termasuk keputusan korban, pelaku, dan peran kepolisian, yang dapat mempengaruhi penerapan restorative justice. Sedangkan, faktor eksternal yang mempengaruhi penerapan restorative justice adalah isu yang sedang beredar di masyarakat dan peranan media. Sebenarnya, penerapan elemen dan keberhasilan restorative justice sudah tercapai, namun belum maksimal karena reaksi masyarakat yang negatif pada korban atau pelaku. Sedangkan, peranan kepolisian, sebagai inisiator dan fasilitator dalam restorative justice, sebenarnya sudah baik. Namun, masih perlu ada sosialisasi dan pelatihan penerapan restorative justice, supaya interpretasi terhadap Peraturan Kapolri Nomor 8 Tahun 2021 dapat sama dan keterampilan yang dimiliki dapat lebih baik.
This thesis discusses the application of restorative justice in solving defamation cases at Sub Directorate IV Cyber Crime Polda Metro Jaya. This thesis uses a qualitative approach with a case study of defamation that occurred on X's Twitter. The researcher conducted observations and interviews with four research informants. By associating it with the concepts in restorative justice, the researcher found the factors that influence the application of restorative justice. In addition, the researcher also analyzed the elements contained in the application of restorative justice, the role of the police, and the success of restorative justice. The results of the research prove that there are internal factors, including the decisions of victims, perpetrators, and the role of the police, which can affect the application of restorative justice. Meanwhile, external factors that influence the application of restorative justice are issues currently circulating in society and the role of the media. Actually, the application of the elements and the success of restorative justice has been achieved, but it has not been maximized because of the negative public reaction to the victim or perpetrator. Meanwhile, the role of the police, as the initiator and facilitator in restorative justice, is actually good. However, there is still a need for socialization and training in the application of restorative justice, so that the interpretation of the Chief of Police Regulation Number 8 of 2021 can be the same and the skills possessed can be better. |
