Dalam arisan, terdapat hubungan perikatan antara anggota arisan dengan ketua atau pemilik arisan terkait. Adapun umumnya, arisan dilaksanakan hanya dengan adanya kesepakatan secara lisan antara anggota dan ketua. Kegiatan arisan online tidak luput dari berbagai masalah seperti lalainya para pihak dalam melaksanakan kewajibannya. Skripsi ini akan secara spesifik membahas perkara pada putusan Nomor 1/Pdt.G. S/2021/PN Trt mengenai arisan online. Pemilik arisan dalam putusan merupakan seseorang yang belum cakap untuk melakukan hubungan hukum perikatan. Terlebih, pemilik arisan memberikan pernyataan yang tidak benar mengenai arisannya kepada anggota-anggota arisannya. Kedua hal tersebut tentu saja mempengaruhi syarat sah perjanjian sebagaimana diatur dalam Pasal 1320 KUHPerdata dan Pasal 46 ayat (2) PP PSTE. Atas kelalaian pemilik arisan yang tidak membayarkan uang arisan anggotanya, anggota arisan akhirnya mengajukan gugatan kepada pemilik arisan. Atas gugatan tersebut, hakim atas dasar keadilan dan kepatutan memutus bahwa anggota arisan akan mendapatkan ganti rugi sebesar uang arisan yang disetorkannya kepada pemilik arisan. Di lain sisi, bunga konventional dalam perjanjian tersebut tidak dipenuhi oleh Hakim karena tidak berdasar oleh hukum. Hal tersebut tidaklah benar adanya karena sebenarnya telah diatur dalam Pasal 1246 KUHPerdata. Di lain sisi, keputusan Hakim dibuat berdasarkan wewenangnya sebagaimana diatur dalam UU Kekuasaan Kehakiman. Skripsi ini akan membahas keabsahan perjanjian arisan online, pengajuan gugatan wanprestasi, dan konsep ganti rugi dalam putusan tersebut. In arisan, there is an engagement relationship between members of the arisan and the chairman or owner of the arisan. In general, arisan is carried out only with an oral agreement between the members and the chairman. Online arisan activities are not free from various problems such as the negligence of the parties in carrying out their obligations. This thesis will specifically discuss the case in decision Number 1/Pdt.G. S/2021/PN Trt regarding online social gathering. The owner of the arisan in the decision is someone who is not yet competent to enter into a legal relationship. Moreover, the owner of the arisan gave incorrect statements regarding his arisan to his arisan members. Both of these affect the legal terms of the agreement as stipulated in Article 1320 of the Civil Code and Article 46 paragraph (2) PP PSTE. Due to the negligence of the arisan owner who did not pay the arisan members' money, the arisan member finally filed a lawsuit against the arisan owner. Based on the lawsuit, the judge on the basis of fairness and propriety decided that the members of the arisan would receive compensation in the amount of the arisan money that they deposited with the arisan owner. On the other hand, conventional interest in the agreement is not fulfilled by the Judge because it is not based on law. This is not true because in fact it has been regulated in Article 1246 of the Civil Code. On the other hand, judge decisions are made based on their authority as stipulated in the Judicial Powers Law.
