Dalam Pasal 5 huruf g dan huruf h Qanun no. 11 tahun 2018 tentang Lembaga Keuangan Syariah ini menjelaskan tujuan dibentuknya lembaga keuangan syariah adalah “ untuk membantu peningkatan pemberdayaan ekonomi dan efektifitas masyarakat; serta menbantu peningkatan pendapatan dan kesejahteraan masyarakat”. Oleh sebab itu, rumusan masalahnya adalah bagaimana dampak kebijakan merger Bank Syariah Indonesia terhadap kesejahteraan pekerja di provinsi Aceh dan efektivitas tujuan penerapan Qanun Aceh No. 11 tahun 2018 tentang Lembaga Keuangan Syariah. Penelitian an tesis ini dilakukan menggunakan metode normative-empiris dengan mengumpulkan data primer dari Pegawai BSI dan masyarakat Aceh. Kemudian data primer tersebut diolah dan dibandingkan dengan aturan terkait kesejahteraan tenaga kerja agar diperoleh hasil efektivitas tujuan penerapan Qanun Aceh. Disimpulkan ada penurunan kesejahteraan bagi para pekerja terkait perbedaan sarana dan fasilitas yang diperoleh. Selain itu perusahaan juga belum memenuhi bagian pelatihan kerja dan kewajiban memberikan gaji yang adil pagi pekerja setelah merger. Tingkat efektifitas berdasarkan lima indikator pengukuran efektifitas terdapat empat indikator telah memenuhi kriteria ukuran efektivitas, kecuali sarana dan fasilitas pendukung hukum Qanun tidak memenuhi dua kriteria yaitu mudah dilaksanakan serta ringkas. In article 5 letter g and letter h of Qanun no. 11 of 2018 concerning Islamic Financial Institutions explains that the purpose of the establishment of Islamic financial institutions is “to help increase economic empowerment and community effectiveness; and help increase incomes and community welfare”. The author wants to analyze how the impact of the merger policy of Bank Syariah Indonesia on the welfare of workers in the province of Aceh and the effectiveness of the objectives of the implementation of Qanun Aceh No. 11 of 2018 concerning Islamic Financial Institutions. The research in writing this thesis was conducted using the juridical-normative method by collecting primary data from BSI employees and the people of Aceh. Then the primary data is processed and compared with regulations related to the welfare of the workforce in order to obtain the results of the effectiveness of the objectives of implementing the Aceh Qanun. Concludes that there is indeed a decrease in welfare for workers related to the differences in facilities and facilities obtained. In addition, the company also has not fulfilled the job training section and the obligation to provide fair wages to workers after the merger. The level of effectiveness based on five indicators of effectiveness measurement, there are four indicators that have met the criteria for measuring effectiveness, except for the facilities and facilities supporting the Qanun law that do not meet two criteria, namely easy to implement and easy. |
