Skripsi ini membahas tentang permasalahan (1) hak dan tindakan penanggung yang memutuskan secara sepihak tidak memperpanjang manfaat asuransi tambahan dari polis asuransi jiwa sebagai hak dan perbuatan yang melanggar prinsip utmost good faith, dan (2) analisis pertimbangan hukum dalam Putusan Pengadilan Negeri Jakarta Utara Nomor 436/Pdt.G/2020/PN.Jkt.Utr yang berkaitan dengan prinsip utmost good faith. Dalam penelitian ini, metode yang digunakan adalah yuridis normatif dengan menggunakan data sekunder, serta analisis data dilakukan secara kualitatif. Hasil penelitian ini adalah (1) PT FWD Life Indonesia selaku penanggung tidak melanggar prinsip utmost good faith karena tindakannya yang melakukan pemutusan sepihak manfaat asuransi tambahan adalah hak penanggung sepenuhnya dan (2) Penulis menilai pertimbangan hukum dalam putusan tersebut adalah keliru karena Majelis Hakim menganggap bahwa tindakan pemutusan sepihak oleh penanggung merupakan pelanggaran prinsip utmost good faith. Penulis menyarankan agar tertanggung memperhatikan penjelasan agen asuransi dan membaca polis dengan teliti. Di sisi lain, penanggung hendaknya menjelaskan secara rinci mengenai manfaat asuransi, serta hak dan kewenangan perusahaan asuransi dalam memperpanjang masa asuransi tersebut. Majelis Hakim diharapkan untuk memperhatikan kembali pengaturan prinsip utmost good faith di dalam KUHD dan UU Perasuransian agar tidak terjadi penafsiran yang salah. This undergraduate thesis discusses the problems of (1) the rights and actions of the insurer who unilaterally decides not to extend additional insurance benefits from a life insurance policy as a right and act that breaches the principle of utmost good faith and (2) analysis of legal considerations in North Jakarta District Court Decision Number 436/Pdt.G/2020/PN.Jkt.Utr, which deals with the principle of utmost good faith. In this study, the method used is normative juridical using secondary data, and data analysis is carried out qualitatively. The results of this research are (1) PT FWD Life Indonesia as the insurer does not breach the principle of utmost good faith because his action to terminate additional insurance benefits unilaterally is the full right of the insurer, and (2) The author considers that the legal considerations in the decision were wrong because the Panel of Judges considered that unilateral termination by the insurer is a breach of the utmost good faith principle. The author suggests that the insured pay attention to the insurance agent's explanation and read the policy carefully. On the other hand, the insurer should explain in detail the benefits of the insurance, as well as the rights and authorities of the insurance company in extending the insurance period. The Panel of Judges is expected to pay attention again to the arrangement of the principle of utmost good faith in the Commercial Code and the Insurance Law so that wrong interpretation does not occur. |
