Dalam suatu perjanjian asuransi Prinsip Utmost Good Faith merupakan salah satu hal yang penting, karena prinsip ini mengatur bahwa Kedua Pihak dalam perjanjian asuransi yaitu penanggung dan tertanggung wajib memberikan informasi yang benar dan jujur. Penelitian ini membahas 2 Permasalahan yaitu 1. Mengenai Pengaturan Prinsip Utmost Good Faith dalam Hukum Asuransi Indonesia dan, 2. Bagaimana Penerapan prinsip utmost good faith Dalam putusan Nomor 182/Pdt.G/2020/Yyk . Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan data sekunder, data yang dilakukan adalah secara kualitatif. Hasil dari Penelitian menyatakan bahwa (1) Prinsip Utmost Good Faith diatur dalam KUHD pasal 251 untuk pihak tertanggung supaya secara jujur menyampaikan informasi dan data mengenai objek yang diasuransikan dalam proses membuat perjanjian asuransi, dan untuk pihak tertanggung diatur dalam Undang-Undang no 40 tahun 2014 Pasal 26 yang mengatur kewajiban penanggung asuransi. (2) Putusan Majelis Hakim masih belum tepat dan tidak ada pertimbangan terkait pelanggaran prinsip utmost good faith dalam pertimbangan hukumnya. Hakim tidak mempertimbangkan ketentuan yang terdapat dalam KUHD dan juga Undang-Undang no 40 tahun 2014 dalam memutus perkara ini dimana Penanggung tidak melaksanakan kewajibannya dalam perjanjian asuransi berdasarkan Undang-Undang tersebut. Dari Penelitian ini saran yang dapat diberikan adalah Hakim diberi materi hukum asuransi termasuk prinsip Utmost Good Faith dalam pelatihan hakim, sehingga para hakim akan memahami prinsip Utmost Good Faith. In an insurance agreement, the Utmost Good Faith Principle is one of the most important things, because this principle stipulates that the two parties to the insurance agreement, namely the insurer and the insured, must provide correct and honest information. This study discusses 2 problems, namely 1. Concerning the Regulation of the Principle of Utmost Good Faith in Indonesian Insurance Law and, 2. How is the application of the principle of utmost good faith in decision Number 182/Pdt.G/2020/Yyk. The research method used is normative juridical using secondary data, the data used is qualitative. The results of the study state that (1) The principle of Utmost Good Faith is regulated in the Criminal Code article 251 for the insured to honestly convey information and data regarding the insured object in the process of making an insurance agreement, and for the insured party it is regulated in Law No. 40 of 2014 Article 26 which regulates the liability of the insurer. (2) The decision of the Panel of Judges is still not correct and there is no consideration regarding the violation of the principle of utmost good faith in its legal considerations. The judge did not consider the provisions contained in the Criminal Code and also Law No. 40 of 2014 in deciding this case where the Insurer did not carry out its obligations in the insurance agreement based on the Law. From this research, the advice that can be given is that judges are given material on insurance law, including the principles of Utmost Good Faith in the training of judges, so that judges will understand the principles of Utmost Good Fait |
