Penentuan pemberian hak asuh anak akibat perceraian seharusnya dilakukan dengan menerapkan prinsip Best Interest of Child karena pada dasarnya hubungan antara anak dengan orang tua tidak putus akibat perceraian. Anak memiliki hak untuk dapat tumbuh dan berkembang dengan baik sesuai dengan potensinya hingga anak tersebut mencapai usia dewasa. Majelis Hakim memiliki peranan yang besar dalam menentukan pihak mana yang berhak atas penguasaan terhadap hak asuh anak. Berdasarkan latar belakang tersebut, maka bagaimana pengaturan di Indonesia mengatur mengenai penentuan penguasaan terhadap hak asuh anak dan bagaimanakah pengaruh dari prinsip Best Interest of Child dalam penentuan hak asuh anak. Metode penelitian yang digunakan penulis adalah yuridis normatif dengan menekankan pada peraturan perundang-undangan yang berlaku disertai dengan sumber literatur lainnya. Masih kurang jelasnya pengaturan di Indonesia terkait apa yang menjadi parameter khusus dalam penentuan pemberian hak asuh anak setelah putusnya suatu perkawinan akibat perceraian membuat penulis merasa bahwa perlunya dibuat suatu aturan khusus untuk dijadikan suatu tolak ukur dalam penentuan terhadap pemberian hak asuh anak. Determination of child custody due to divorce should be done by applying the principle of Best Interest of Child because basically the relationship between children and parents is not broken due to divorce. Children have the right to be able to grow and develop properly according to their potential until the child reaches adulthood. The Panel of Judges has a major role in determining which party is entitled to control over child custody. Based on this background, how does the regulation in Indonesia regulate the determination of control over child custody and how does the effect of the principle of Best Interest of Child in determining child custody. The research method used by the author is normative juridical by emphasizing the applicable laws and regulations accompanied by other literature sources. The lack of clear regulations in Indonesia regarding what are the specific parameters in determining the award of child custody after the breakdown of a marriage due to divorce makes the author feel that there is a need for a special rule to be made as a benchmark in determining the award of child custody. |
