Skripsi ini membahas mengenai perkembangan norma hukum yang mengatur verifikasi partai politik untuk menjadi peserta pemilihan umum pasca Putusan Mahkamah Konstitusi Nomor 55/PUU-XVIII/2020. Metode penelitian yang digunakan adalah metode yuridis-normatif dengan studi kepustakaan. Kesimpulan dari penelitian ini berdasarkan fakta-fakta yang ditemukan adalah norma hukum verifikasi partai politik untuk menjadi peserta pemilu bersifat dinamis sepanjang penyelenggaraan pemilu pada masa Reformasi. Selain itu, tafsir Mahkamah Konstitusi mengenai keadilan dalam proses verifikasi partai politik untuk menjadi peserta pemilu mengalami perubahan. Putusan MK No. 52/PUU-X/2012 dan Putusan MK No. 53/PUU-XV/2017 menafsirkan keadilan dalam proses verifikasi partai politik dengan menempatkan seluruh partai politik dalam posisi yang sama tanpa perlakuan yang berbeda. Putusan MK No. 55/PUU-XVIII/2020 menggantikan tafsir tersebut dengan mendasarkan pada keadilan yang “memperlakukan sama terhadap sesuatu yang sama dan memperlakukan beda terhadap sesuatu yang berbeda,” sehingga terjadi pembedaan perlakuan antara suatu partai politik dengan partai politik lainnya berdasarkan patokan tertentu. Berdasarkan kesimpulan tersebut, harapan dari Penulis adalah publik berusaha untuk melakukan pengawasan terhadap pembentuk undang-undang dan penyelenggara pemilu demi terwujudnya prinsip-prinsip demokratis dalam pemilu, terutama mengenai verifikasi partai politik untuk menjadi peserta pemilu, terlepas dari kepentingan politik dari pembuat undang-undang dalam menyusun peraturan perundang-undangan mengenai pemilu. This thesis discusses the development of legal norms governing the verification of political parties to become participants in general elections after Constitutional Court Decision Number 53/PUU-XVIII/2020. The research method used is the juridical-normative method with literature study. The conclusion of this research based on the facts found is that the legal norms of verification of political parties to become election participants are dynamic throughout the implementation of elections during the Reformation period. In addition, the Constitutional Court's interpretation of justice in the verification process of political parties to become election participants has changed. Constitutional Court Decision No. 52/PUU-X/2012 and Constitutional Court Decision No. 53/PUU-XV/2017 interpret justice in the political party verification process by placing all political parties in the same position without different treatment. Constitutional Court Decision No. 55/PUU-XVIII/2020 replaces this interpretation by basing it on the maxim that "treats the same to something that is the same and treats differently to something different," so that there is differential treatment between one political party and another political party based on certain benchmarks. Based on these conclusions, the author hopes that the public will try to supervise the legislators and election organizers for the realization of democratic principles in elections, especially regarding the verification of political parties to become election participants, regardless of the political interests of the legislators in drafting election laws and regulations. |
