Dalam mengikuti proses pengadaan di sektor publik maupun privat, setiap pelaku usaha harus mematuhi aturan yang melarang praktik persaingan usaha yang tidak sehat. Salah satu bentuk praktik tersebut adalah persekongkolan tender. Di Indonesia, larangan persekongkolan tender telah diatur dengan jelas dalam Pasal 22 UU No. 5 Tahun 1999. Meski demikian, masih ada banyak pelaku usaha yang berupaya mencari peluang untuk melakukan persekongkolan tender dengan tujuan memenangkan paket tender dan meningkatkan keuntungan. Isu yang diangkat dalam konteks ini adalah praktik persekongkolan tender yang terjadi dalam proses pengadaan Alutsista di Indonesia. Skripsi ini menganalisis terkait dugaan persekongkolan tender Pengadaan Helikopter TNI Angkatan Udara AgustaWestland-101 Tahun Anggaran 2016 berdasarkan Putusan Pengadilan Negeri Jakarta Pusat No. 19/Pid.Sus-TPK/2023/PT DKI. Metode penelitian yang dilakukan penulis adalah yuridis normatif yang didasarkan pada hukum tertulis yang membantu masyarakat dalam bertindak. Proses tender pengadaan Helikopter AgustaWestland-101 oleh TNI AU telah sesuai dengan pengaturan yang diatur di dalam Peraturan Presiden Nomor 54 Tahun 2010. Walaupun dalam praktiknya terdapat beberapa perilaku yang tidak mencerminkan adanya prinsip serta etika dalam melakukan pengadaan. Tender pengadaan Helikopter AgustaWestland-101 oleh TNI AU tahun anggaran 2016 tidak dapat dikatakan sebagai praktik persekongkolan tender. Tidak semua tanda atau indikasi yang ditemukan oleh penulis dapat dengan pasti membuktikan adanya persekongkolan yang tidak sehat. In participating in procurement processes in both the public and private sectors, every business entity must comply with regulations that prohibit unhealthy business competition practices. One of such practices is tender collusion. In Indonesia, the prohibition of tender collusion has been clearly stipulated in Article 22 of Law No. 5 of 1999. However, there are still many businesses that attempt to find opportunities to engage in tender collusion with the aim of winning tender contracts and increasing profits. The issue raised in this context is the practice of tender collusion in the procurement process of Alutsista (main weapon systems) in Indonesia. This thesis analyzes the alleged tender collusion in the procurement of AgustaWestland-101 helicopters by the Indonesian Air Force in the 2016 fiscal year, based on the verdict of the Central Jakarta District Court No. 19/Pid.Sus-TPK/2023/PT DKI. The research method employed by the author is normative juridical, based on written laws that assist society in taking action. The tender process for the procurement of AgustaWestland-101 helicopters by the Indonesian Air Force has been in accordance with the regulations stipulated in Presidential Regulation No. 54 of 2010. However, in practice, there have been several behaviors that do not reflect the principles and ethics of procurement. The tender for the procurement of AgustaWestland-101 helicopters by the Indonesian Air Force in the 2016 fiscal year cannot be considered as a practice of tender collusion. Not all the signs or indications found by the author can definitively prove the existence of unhealthy collusion. |
