Tesis ini membahas tentang pertanggungjawaban perusahaan asuransi usaha bersama AJBB 1912 atas terjadinya gagal bayar klaim asuransi dalam Putusan Pengadilan Negeri Maumere Nomor: 2/PDT.G/2021/PN Mme. dan Jakarta Selatan Nomor: 482/PDT.G/2020/PN Jkt. Sel. Adapun permasalahan yang dibahas dalam penelitian ini terbagi atas dua masalah, yakni: pertama, bagaimana upaya hukum yang dapat dilakukan pemegang polis AJBB 1912 atas perintah eksekusi putusan untuk membayar klaim asuransi berdasarkan putusan Pengadilan Negeri Maumere dan Jakarta Selatan Pengadilan Negeri Jakarta Selatan yang telah berkekuatan hukum tetap namun eksekusi tetap tidak dilaksanakan oleh AJBB 1912; dan kedua, bagaimanakah pertanggungjawaban AJBB 1912 yang tidak mau menjalankan perintah eksekusi atas kedua putusan tersebut. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis-normatif dengan data sekunder, dan analisis data dilakukan secara kualitatif. Hasil dari penelitian ini menunjukkan bahwa upaya hukum yang dapat dilakukan oleh Para Pemegang Polis AJBB 1912 adalah dengan menempuh upaya litigasi dan mengadukan permasalahan yang dihadapi ke OJK. Selanjutnya, bentuk pertanggungjawaban dari AJBB 1912 atas tidak dilaksanakannya perintah eksekusi atas kedua putusan tersebut adalah dengan melakukan penjualan sebagian asetnya untuk melaksanakan perintah eksekusi atas putusan pengadilan. Saran dari penelitian ini adalah bahwa OJK perlu untuk memberikan peringatan dan tekanan kepada AJBB 1912 untuk melaksanakan perintah eksekusi atas putusan pengadilan dan agar AJBB 1912 segera menjual sebagian asetnya untuk dapat melaksanakan perintah eksekusi atas putusan pengadilan. This thesis presents the results of research or studies on the liability of The Mutual Insurance Company AJBB 1912 for failure of payment in insurance claims on the Maumere District Court Decision No. 2/PDT.G/2021/PN Mme and South Jakarta No. 482/PDT.G/2020/PN Jkt.Sel. The problems discussed in this research are divided into two problems, namely: first, how are the legal efforts that can be taken by the AJBB 1912 policy holders against the order to execute both court decisions which have executable legal force but the execution is still not carried out by AJBB 1912; and second, how are the liabilities of AJBB 1912 who doesn’t want to carry out the execution order of both the court decisions. The research method used in this research is juridical-normative with secondary data, and data analysis is carried out qualitatively. The results of this study indicate that the legal efforts that can be taken by the AJBB 1912 Policy Holders are by taking litigation efforts and reporting the problems they face to the OJK. Furthermore, the form of liability from AJBB 1912 for not carrying out the execution order for the two decisions is by selling part of its assets to carry out the execution order for the court decision. The suggestion from this research is that the OJK needs to give a warning and pressure towards AJBB 1912 to carry out the execution order on the court decisions and so that AJBB 1912 immediately sells some of its assets so that it can carry out the execution order on the court decisions. |
