Maraknya transaksi yang terjadi dalam pasar modal dapat menyebabkan peluang untuk melakukan pelanggaran dalam pasar modal demi mendapatkan keuntungan lebih. Investor selaku pelaku dalam pasar modal yang merupakan pihak yang cenderung lemah kerap menjadi korban atas pelanggaran yang dilakukan oleh pelaku dalam pasar modal lainnya. Pelanggaran yang terjadi dalam pasar modal kerap dilakukan oleh pihak perusahaan efek selaku pengelola modal milik investor. Oleh karena itu, Otoritas Jasa Keuangan selaku pengawas dan regulator dalam sektor jasa keuangan wajib mengikuti perkembangan yang terjadi dalam pasar modal sehingga dapat menindaklanjuti pihak-pihak yang melakukan pelanggaran. Pencabutan izin usaha oleh Otoritas Jasa Keuangan merupakan salah satu sanksi yang dapat dikenakan apabila adanya pelanggaran oleh perusahaan efek. Hal ini dilakukan agar perusahaan efek tersebut tidak akan membahayakan aset-aset milik investor dan akan memberikan perlindungan bagi investor. Namun, dengan pencabutan izin usaha perusahaan efek, pemulihan keadaan atau ganti kerugian terhadap pihak investor yang telah mengalami kerugian akibat perbuatan pelanggaran perusahaan efek tersebut masih diperlukan. Hasil dari penelitian menunjukan bahwa dengan dilakukan pencabutan izin usaha terhadap perusahaan efek yang melakukan pelanggaran oleh Otoritas Jasa Keuangan, maka perusahaan efek tersebut tidak akan membahayakan aset milik investor dan mencegah adanya kehilangan aset serta memberikan efek jera terhadap perusahaan efek tersebut, kemudian apabila terdapat investor yang masih mengalami kerugian dapat menempuh jalan keluar melalui gugatan, dana perlindungan pemodal, disgorgement fund, maupun cara lain yang telah ditentukan oleh Otoritas Jasa Keuangan. The frequent amount of transactions that occur in the capital market can lead to opportunities to commit violations in the capital market in order to gain more profits. Investors as one of the actors in the capital market who are parties that tends to be weaker than other parties often become victims of violations committed by other parties in the capital market. Violations that occur in the capital market are often committed by securities companies as investors' capital managers. Therefore, the Financial Services Authority as the supervisor and regulator in the financial services sector must be aware of developments in the capital market so that they can take actions on parties who commit violations. Revocation of a business license by the Financial Services Authority is one of the sanctions that can be imposed if there is a violation by a securities company. This is done so that the securities company will not endanger the investors' assets and will provide protection for investors. However, with the revocation of the securities company's business license, recovery or compensation for investors who have suffered losses as a result of the securities company's violations is still required. The results of the thesis shows that by revoking the business license of securities companies that commit violations by the Financial Services Authority, these securities companies will not be able to endanger the assets of investors anymore and prevent further loss of assets and provide a deterrent effect on these securities companies, then if there are investors who still experiencing a loss can find a way out through lawsuits, investor protection funds, disgorgement funds, or other methods determined by the Financial Services Authority. |
