Tulisan ini menganalisis apakah tindakan Kompas dalam kasus Kompas dengan Content Creator binaan PT KCIC dapat dilindungi dengan Pasal 43 dan Pasal 44 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UU Hak Cipta). Sebagian besar Perusahaan Pers di Indonesia telah memanfaatkan YouTube sebagai media untuk menyajikan informasi. Kasus menarik terjadi antara salah satu Perusahaan Pers yang cukup diketahui oleh masyarakat di Indonesia, Kompas dan seorang Youtuber mitra Kereta Cepat Indonesia China (KCIC) dimana Kompas TV dan Kompas.com (selanjutnya akan disebut Kompas) menerima dua tuntutan klaim Hak Cipta video YouTube atau YouTube copyright strike yang dilayangkan oleh Content Creator binaan Kereta Cepat Indonesia China (KCIC). Dapat dikenakannya copyright strike terhadap konten berita dari Kompas tersebut mengindikasikan bahwa sebuah kegiatan Jurnalistik yang disampaikan dalam bentuk konten melalui media channel YouTube dapat dianggap oleh YouTube sebagai pelanggaran Hak Cipta apabila dalam konten tersebut terdapat footage milik Pencipta asli, dan Pencipta tersebut menyatakan keberatan atas penyebarluasan konten miliknya. Pembatasan Hak Cipta dapat diberlakukan bagi tindakan Kompas apabila Kompas tidak memonetisasi kontennya sehingga tindakan Kompas tidak dapat dilindungi dengan Pasal 43 UU Hak Cipta, namun ketika konten tersebut dibuat untuk tujuan pendidikan maka tindakan Kompas dapat dilindungi dengan Pasal 44 UU Hak Cipta. This paper analyzes whether Kompas's actions in the Kompas case with Content Creators fostered by PT KCIC can be protected by Article 43 and Article 44 of Law Number 28 of 2014 concerning Copyright (Copyright Law). Most Press Companies in Indonesia have used YouTube as a medium to present information. An interesting case occurred between one of the Press Companies that is well known to the public in Indonesia, Kompas and a Youtuber partner of Kereta Cepat Indonesia China (KCIC) where Kompas TV and Kompas.com (hereinafter referred to as Kompas) received two claims for YouTube video copyright or YouTube copyright strike filed by Content Creators fostered by Kereta Cepat Indonesia China (KCIC). The imposition of copyright strikes on news content from Kompas indicates that a journalistic activity delivered in the form of content through the YouTube channel media can be considered by YouTube as copyright infringement if the content contains footage belongs to the original Creator, and that Creator expresses objection to the dissemination of his content. Copyright restrictions can be applied to Kompas's actions if Kompas does not monetize its content so that Kompas's actions cannot be protected by Article 43 of the Copyright Law, but when the content is made for educational purposes, Kompas's actions can be protected by Article 44 of the Copyright Law. |
