Penulisan karya ilmiah ini dilatarbelakangi karena adanya permasalahan penanganan pemilu pada tahun 2019 oleh Polresta Bandar Lampung yang mengalami kesulitan dalam mengatasi konflik sosial. Penegakan hukum represif sudah dilakukan, namun belum mampu meredam konflik yang terjadi. Pada akhirnya penegakan hukum melalui sisi pencegahan juga dilakukan walaupun menurut teori konflik sosial bahwa konflik sosial tidak mungkin dicegah karena masyarakat menginginkan perubahan.Permasalahan tersebut dikaji dengan teori konflik sosial, teori penegakan hukum penal dan non penal, konsep pemolisian masyarakat. Sedangkan jenis penelitian ini adalah penelitian kualitatif dengan dengan metode pendekatan penelitian lapangan (field research). Hasil penelitian ini menunjukkan bahwa penegakan hukum terhadap tindak pidana pemilu yang dilakukan Satreksrim Polresta Bandar Lampung khususnya dalam melakukan penyelidikan kejahatan politik uang tidak dilanjutkan ke tahap penyidikan karena kompetensi penyidik belum sesuai syarat yang ditentukan oleh undang-undang Pemilu. Penanganan kasus hoax, hate speech yang dapat memicu konflik juga belum mampu memberikan efek jera kepada pelaku kejahatan tersebut. Oleh karenanya dilakukan upaya pencegahan melalui polisi masyarakat agar masyarakat dapat turut menjaga Kamtibmas. Hambatan-hambatan yang dihadapi dalam melakukan penegakan hukum dalam mengatasi konflik sosial pada Pemilu 2019 adalah, belum optimalnya pelaksanaan Asta Siap, Metode pencegahan belum optimal melalui satuan fungsi pencegahan, kompetensi, sarana prasarana serta perilaku anggota juga belum dioptimalkan dalam mencapai tujuan dalam menjaga Kamtibmas.
This research is motivated by the increasing number of irregularities or violations of the background to writing this scientific work was the problem of handling the 2019 election by the Bandar Lampung Police, which experienced difficulties in overcoming social conflicts. Repressive law enforcement has been carried out, but has not been able to reduce the conflict that occurred. In the end, law enforcement through prevention is also carried out even though according to social conflict theory it is impossible to prevent social conflict because society wants change.This problem is studied using social conflict theory, penal and non-penal law enforcement theory, and the concept of community policing. Meanwhile, this type of research is qualitative research using a field research approach method.The results of this research indicate that law enforcement regarding election crimes carried out by the Bandar Lampung Police Criminal Investigation Unit, especially in conducting investigations into money politics crimes, did not proceed to the investigation stage because the investigators' competence did not meet the requirements determined by the Election law. Handling cases of hoaxes and hate speech which can trigger conflict has also not been able to provide a deterrent effect to the perpetrators of these crimes. Therefore, preventive efforts are being made through community police so that the community can participate in maintaining security and order. The obstacles faced in enforcing the law in overcoming social conflict in the 2019 elections are that the implementation of Asta Siap is not yet optimal, prevention methods are not yet optimal through prevention function units, competence, infrastructure and member behavior have also not been optimized in achieving the goal of maintaining Public Order and Order. |
