Pengaturan pengelolaan sumber daya migas yang tercantum dalam Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi mengatur bahwa dalam melakukan pengelolaan sumber daya migas saat ini dilakukan berdasarkan Kontrak Kerja Sama. Adapun Kontrak Kerja Sama saat ini dilakukan dalam bentuk Kontrak Bagi Hasil (Production Sharing Contract) yang dilakukan antara SKK Migas dan Kontraktor yang berasal dari perusahaan minyak nasional maupun asing. Namun rupanya sistem pengelolaan sumber daya migas saat ini dianggap tidak sesuai dengan amanah yang terkandung dalam Pasal 33 ayat (3) UUD 1945 sebagai cita-cita Indonesia dalam melakukan penguasaan atas sumber daya migasnya. Diantaranya adalah karena terdapatnya pengusahaan asing yang melakukan pengelolaan sumber daya migas, sistem pengelolaan yang dilakukan berdasarkan Kontrak Bagi Hasil (Production Sharing Contract), dan sumber daya migas yang tidak dikelola langsung oleh Perusahaan Negara. Permasalahan yang diangkat dalam skripsi ini adalah pemahaman atas perkembangan sistem pengelolaan sumber daya migas, bentuk kerja sama pengelolaan sumber daya migas berdasarkan Pasal 33 ayat (3) UUD 1945, serta analisis pengelolaan sumber daya migas saat ini yang sesuai dengan Pasal 33 ayat (3) UUD 1945. Metode yang digunakan untuk menganalisis permasalahan tersebut adalah yuridis normatif. Hasil dari penelitian ini yaitu pemahaman terhadap sistem pengelolaan migas dengan berbasis Kontrak Bagi Hasil (Production Sharing Contract) saat ini tidaklah bertentangan dengan Pasal 33 ayat (3) UUD 1945. Namun, penguasaan negara yang terkandung dalam cita-cita Pasal 33 ayat (3) UUD 1945 sebagaimana yang ditafsirkan oleh Mahkamah Konstitusi saat ini tidak memenuhi unsur pengelolaan langsung yang dilakukan oleh Negara.

Oil and gas operation Natural Oil and Gas Act No. 22 year 2001 regulate that in managing oil and gas is performed based on Contract. The contract is currently performed in the form of Production Sharing Contracts that made between SKK Migas and Contractors that come from both national and foreign oil companies. But apparently the oil and gas operation system is currently considered not in accordance with the mandate contained in Article 33 paragraph (3) of the 1945 Constitution, as the ideals of Indonesia in controlling the oil and gas resources. The reason told among them are due to the presence of foreign that conduct oil and gas resource operation, operation system that been done under Production Sharing Contracts, and oil and gas resources that has been not managed directly by the State Company. The issue in this thesis are the understanding of the history of oil and gas resource operation system, forms of cooperation operation of oil and gas resources under Article 33 paragraph (3) of the 1945 Constitution, as well as the analysis of the operation of today's oil and gas resources in accordance with Article 33 paragraph (3) 1945 Constitution. The method used in analyze this thesis is a normative juridical. The result of this study is the understanding of the oil and gas operation system based on production sharing contracts today is not contrary to Article 33 paragraph (3) of the 1945 Constitution. However, the control of the state contained in the ideals of Article 33 paragraph (3) of the 1945 Constitution as interpreted by the Constitutional Court does not currently meet the elements of direct operation by the State.
