ABSTRAKSkripsi ini membahas mengenai perkawinan antar pemeluk agama yang berbeda
di Indonesia. Penelitian ini adalah penelitian yuridis normatif yaitu tata cara
pengumpulan data yang berasal dari bahan-bahan kepustakaan dan peraturan
perundang-undangan terkait. Penelitian didasarkan pada Undang-Undang
Perkawinan dan Undang-Undang Administrasi Kependudukan. Berdasarkan hasil
penelitian diketahui bahwa terdapat perbedaan antara kedua Undang-Undang
tersebut. Undang-Undang Perkawinan menyerahkan perkawinan antar pemeluk
agama yang berbeda pada agama masing-masing calon mempelai sedangkan
Undang-Undang Administrasi Kependudukan mengakui perkawinan antar
pemeluk agama yang berbeda melalui putusan pengadilan. Hasil penelitian
menyarankan bahwa harus terdapat kejelasan mengenai pengaturan perkawinan
beda agama di Indonesia dengan mengamandemen undang-undang yang telah
ada
ABSTRACTThis thesis discusses on interfaith marriages in Indonesia. The research for this
thesis is normative juridicial, which involves the collection of data from literary
sources and associated legal ordinances. This research is based on Marriage Laws
and Population Administration Laws. Based on the findings of the research, it is
discovered that there exists certain inconsistencies between both Laws. The
Marriage Laws provides that interfaith marriages are subject to the religion of
each partner, while the Population Administration Laws states that interfaith
marriages have to obtain an affirmative decision of the court. The results of the
research propose further clarification of the regulations relating to interfaith
