[Tesis ini membahas tentang merek yang “telah menjadi milik umum” dan merek yang “merupakan keterangan atau berkaitan dengan barang atau jasa yang dimohonkan pendaftarannya” sebagaimana Pasal 5 huruf c dan huruf d Undang-Undang No. 15 Tahun 2001 tentang Merek, serta bagaimana keterkaitan antara keduanya.
