ABSTRAK
Dalam Pasal 33 UUD 1945, semangat Koperasi ditempatkan sebagai semangat dasar perekonomian bangsa Indonesia. Melalui Pasal 33 UUD 1945, bangsa Indonesia bermaksud untuk menyusun suatu sistem perekonomian usaha bersama berdasar atas asas kekeluargaan. Sebagaimana dikemukakan oleh Bung Hatta, yang dimaksud dengan usaha bersama berdasar atas asas kekeluargaan dalam Pasal 33 ayat 1 UUD 1945 itu, tidak lain adalah Koperasi sebagaimana dikemukakan di dalam penjelasan pasal tersebut. Karena itulah, di dalam penjelasan Pasal 33 UUD 1945, Koperasi dinyatakan sebagai bangun usaha yang sesuai dengan sistem perekonomian yang hendak dikembangkan di Indonesia. Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian dikatakan mengandung kapitalisme dikarenakan prinsip-prinsip yang tertuang dalam undang-undang terbaru mengutamakan modal dan individualisme yang menjadikan ciri utama dari kapitalisme. Ini dapat dilihat dalam Pasal 1 Angka 1 Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian. Penelitian ini akan menguji bagaimana penerapan asas kekeluargaan yang merupakan landasan koperasi dalam Undang-Undang Nomor 17 Tahun 2012 Tentang Koperasi. Penelitian ini juga mengkaji interpretasi asas kekeluargaan hakim dalam Keputusan Mahkamah Konstitusi Nomor 28/PUU-XI/2013. Hasil penelitian Penerapan asas kekeluargaan yang merupakan landasan koperasi dalam Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian tidak sesuai dengan yang diharapkan oleh masyarakat. Banyak pasal-pasal dalam Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian yang bertentangan dengan asas kekeluargaan, yaitu Pasal 1 angka 1, Pasal 55 ayat (1), Pasal 68, Pasal 69, dan Pasal 78 ayat (2) Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian

ABSTRACT
In Article 33 UUD 1945, cooperative spirit was placed as the basic spirit of the Indonesian economy. Through Article 33 UUD 1945, the nation of Indonesia intends to draw up a joint venture economic system based on family principles. As noted by Bung Hatta, is a joint venture based on family principles in Article 33, paragraph 1 of the 1945 Constitution, is nothing but a cooperative, as noted in the explanation of the chapter. Therefore, in the explanation of Article 33 UUD 1945, the Cooperative expressed as a wake-up business in accordance with the economic system to be developed in Indonesia. Law No. 17 of 2012 concerning Cooperatives said to contain capitalism because of the principles contained in the latest legislation prioritizes capital and individualism that makes the main characteristic of capitalism. This can be seen in Article 1 paragraph 1 of Law No. 17 of 2012 concerning Cooperatives. This study will examine how the application of the principle of family being the foundation of the cooperative in Law No. 17 of 2012 on Cooperatives. This study also examines the interpretation of the principle of family judges in the Constitutional Court Decision No. 28 / PUU-X / 2013. Application of the principle of family research results that are the foundation of cooperatives in Law No. 17 of 2012 concerning Cooperatives are not as expected by the public. Many articles of the Law No. 17 Year 2012 concerning Cooperatives are contrary to the principle of the family, namely Article 1 paragraph 1, Article 55 paragraph (1), Article 68, Article 69 and Article 78 paragraph (2) of Law No. 17 of 2012 concerning Cooperatives.
