ABSTRAKPada Putusan Pengadilan Negeri Pati Nomor 88/Pdt.G/2013/PN.PTBahwa dalam perkara tersebut telah terjadi jual beli antara Penggugat danTergugat I amp; Tergugat II, jual beli tersebut telah dimuat ke dalam akta jual beli,setelah terjadi jual beli, Tergugat I amp; Tergugat II membujuk Penggugat yangsedang kesulitan keuangan untuk dapat memeriksa sertipikat atas jual beli tersebutapakah dapat dijadikan jaminan/agunan, namun Penggugat hanya memberi izinsebatas memeriksa apakah sertipikat tersebut dapat dijadikan jaminan/agunan,akan tetapi Penggugat kemudian mengetahui jika sertipikat tersebut telahdijaminkan dan dibebani hak tanggungan dengan melawan hukum dan tanpasepengetahuan Penggugat kepada pihak Bank BTN. Majelis hakim PengadilanNegeri Pati memutus bahwa jual beli tersebut adalah sah dan menyatakan batalhak tanggungan serta menghukum kreditur untuk menyerahkan sertipikat atasbenda jaminan. Bahwa dengan diputusnya putusan tersebut, hak tanggungan atasbenda jaminan dianggap batal, dan dari pembatalan ini membawa akibat bagibeberapa pihak.
ABSTRACTOn the jurisprudence of Pati Distric Court Number88 Pdt.G 2013 PN.PT. there has been a sale and purchase between the seller andthe buyer, that transaction has been included in the deed of sale. After thattransaction, the seller persuade the buyer who are in need of money to be able tocheck the certificate of the transaction whether it can be used as collateral or not,and the buyer only purchases limited permission to check whether the certificatecan be used as collateral, but it turns out the buyer than finds out if the certificatehas been pledged and burdened by the mortgage by unlawfully without knowingof the buyer to the Bank of BTN. Panel of judges at Pati Distric court hasjudgement that buying and selling is legitimate and cancel the mortgage right andpunish the creditor to submit the certificate of the guarantee object. However withthat judgement, the mortgage right of the guarantee object considered cancel, andfrom this cancellation, has give the effect to some parties.
